Date: 10.5.94 Ma ga et Monroe, City Planner RESOLUTION NO. 45-94 RESOLUTION APPROVING CATEGORICAL EXEMPTION AND VARIANCE RESOLVED, by the Planning Commission of the City of Burlingame that: WHEREAS , a categorical exemption has been proposed and application has been made for a side setback variance for the construction of a garage built to side property ( 0 ' -011 ) line where a 6 ' -0" setback is recuired at 152 Elm Avenue , zoned R-1 , APN: 028-263-080 ; property owner: Geoffrey & Sally Reid , 152 Elm Avenue ; and WHEREAS, said matters were heard by the Planning Commission of the City of Burlingame on September 26 , 1994 , at which time it reviewed and considered the staff report and all other written materials and testimony presented at said hearing; NOW, THEREFORE, it is RESOLVED and DETERMINED by this Planning Commission that: 1 . On the basis of the Initial Study and the documents submitted and reviewed, and comments received and addressed by this commission, it is hereby found that there is no substantial evidence that the project set forth above will have a significant effect on the environment, and categorical exemption Section: 15302 - Replacement or Reconstruction Class 2 (b) , Replacement of a commercial structure with a new structure of substantially the same size, purpose, and capacity is hereby approved. 2 . Said variance is approved subject to the conditions set forth in Exhibit "A" attached hereto . Findings for such variance are as set forth in the minutes and recording of said meeting. 3 . It is further directed that a certified copy of this resolution be recorded in the official records of the County of San Mateo. s I CHAIRMAN I , Mike Ellis , Secretary of the Planning Commission of the City of Burlingame, do hereby certify that the foregoing resolution was introduced and adopted at a regular meeting of the Planning Commission held on the 26th day of September , 1994 , by the following vote : AYES : COMMISSIONERS : ELLIS, JACOBS, KELLY, KEY AND GALLIGAN NOES : COMMISSIONERS : NONE ABSENT: COMMISSIONERS : DEAL AND MINK SECRETARY EXHIBIT "A" Conditions of approval categorical exemption and variance 152 ELM AVENUE effective OCTOBER 3, 1994 1. that the project shall be built as shown on the plans submit- ted to the Planning Department and date stamped August 8, 1994, General Site Plan, Front Elevation, Side Elevation and Foundation/Floor Plan, with the following revisions: a. the City Engineer and the Chief Building Official shall approve the drainage and the location of the exterior garage wall prior to the issuance of the building permit, b. the eave of the new roof shall not extend over the property line and all drainage shall go to the street, c. the completed garage shall have and interior dimension of no less than 181X 20' and that the following conditions shall be included in the plans prior to issuance of the building permit; 2 . that the tie in of the new garage roof shall not exceed 13 '-0" from existing grade at the front of the existing carport; 3 . that the existing height of the carport roof shall be surveyed prior to its demolition and the new garage roof height shall be surveyed and the survey approved by the City Engineer prior to the addition of roofing materials and finaling of the building permit; and 4 . that the project shall meet all Uniform Building and Uniform Fire Code requirements as amended by the City.
