Date: 11.8.94 Marg et Monroe, City Planner RESOLUTION NO. 53-94 RESOLUTION APPROVING CATEGORICAL EXEMPTION AND SPECIAL PERMIT FOR AUTOMOBILE SALES AND STORAGE RESOLVED, by the Planning Commission of the City of Burlingame that: WHEREAS, a categorical exemption has been proposed and application has been made for a special permit for automobile sales and storage at 1291 Whitethorn Way, APN: 026-131-190; owner: Nicholas and Stella Crisafi, 808 Burlway Road ; and WHEREAS, said matters were heard by the Planning Commission of the City of Burlingame on October 24, 1994 , at which time it reviewed and considered the staff report and all other written materials and testimony presented at said hearing; NOW, THEREFORE, it is RESOLVED and DETERMINED by this Planning Commission that: 1. On the basis of the Initial Study and the documents submitted and reviewed, and comments received and addressed by this commission, it is hereby found that there is no substantial evidence that the project set forth above will have a significant effect on the environment, and categorical exemption Section 15301 - Existing Facilities, Class 1(a), Interior or exterior alterations involving such things as interior partitions, plumbing and electrical conveyances is hereby approved. 2. Said special permit is approved subject to the conditions set forth in Exhibit "A" attached hereto. Findings for such Special Permit are as set forth in the minutes and recording of said meeting. 3. It is further directed that a certified copy of this resolution be recorded in the official records of the County of San Mateo. C ik4A& I, Mike Ellis , Secretary of the Planning Commission of the City of Burlingame, do hereby certify that the foregoing resolution was introduced and adopted at a regular meeting of the Planning Commission held on the 24th day of October , 1994 , by the following vote: AYES: COMMISSIONERS: DEAL, ELLIS, JACOBS, KELLY, KEY, MINK AND GALLIGAN NOES: COMMISSIONERS: NONE ABSENT: COMMISSIONERS: NONE SECRETARY EXHIBIT "A" Conditions of approval categorical exemption and special permit 1291 WHITETHORN WAY effective NOVEMBER 7, 1994 1. that the project shall be built as shown on the plans submitted to the Planning Department and date stamped September 9, 1994, Site Plan(81h X 11"); 2. that the conditions of the City Engineer's September 12, 1994 memo and the Fire Marshal's September 12, 1994 memo shall be met; 3. that the business shall be open 9:00 A.M. to 5:00 P.M.Monday through Friday with a maximum of two employees including the proprietor, on site, at any one time; 4. at least one vehicle will be displayed inside the building in accordance with the Department of Motor Vehicle dealers license requirements; 5. that none of the on-site parking shall be used to display or store cars for sale from this business; 6. that vehicles to be sold or displayed by this business shall be delivered before or after regular business hours of other tenants on site;no cars shall be off loaded on the public street or in such a way that required on site parking is blocked; 7. that any changes to this business operation as outlined in the application materials date stamped September 8, 1994 shall require an amendment to this special permit; and 8. that the use and any improvements for the use shall meet all the requirements of the Uniform Building and Uniform fire Codes as amended by the City of Burlingame.
