Date: 11.22.94 Margaret Monroe,City Planner RESOLUTION NO, 55-94 RESOLUTION APPROVING CATEGORICAL EXEMPTION AND PARKING VARIANCE RESOLVED, by the Planning Commission of the City of Burlingame that: WHEREAS,a categorical exemption has been proposed and application has been made for a vaddng variance to allow two parking spaces where three are required (CS 25.70.030(1 at 459 Cumberland Road, APN: 026-163-080; property owner: Peter V. and Patricia L. Nedwick.459 Cumberland Road; and WHEREAS, said matters were heard by the Planning Commission of the City of Burlingame on November 14. 1994 , at which time it reviewed and considered the staff report and all other written materials and testimony presented at said hearing; NOW,THEREFORE, it is RESOLVED and DETERMINED by this Planning Commission that: 1. On the basis of the Initial Study and the documents submitted and reviewed, and comments received and addressed by this commission,it is hereby found that there is no substantial evidence that the project set forth above will have a significant effect on the environment,and categorical exemption Section: 15301 -Class 1 (e)Additions to existing structures provided that the addition will not result in an increase of more than 50% of the floor area of the structures before the addition or 2500 SF, whichever is less is c� hereby approved. 2. Said variance is approved subject to the conditions set forth in Exhibit"A" attached hereto. o0 Findings for such variance are as set forth in the minutes and recording of said meeting. --t W 3. It is further directed that a certified copy of this resolution be recorded in the official records of the County of San Mateo. CC ' IRM I, Mike Ellis,Secretary of the Planning Commission of the City of Burlingame,do hereby certify that the foregoing resolution was introduced and adopted at a regular meeting of the Planning Commission held on the 14th day of November, 1994 ,by the following vote: AYES: COMMISSIONERS DEAL, ELLIS,JACOBS, KELLY AND GALLIGAN NOES: COMMISSIONER MINK ABSENT: COMMISSIONERS KEY SECRETARY EXHIBIT "A" Conditions of approval categorical exemption and parking variance 459 CUMBERLAND ROAD effective NOVEMBER 21, 1994 1. that the project shall be built as shown on the plans submitted to the Planning Department and date stamped October 27, 1994 sheets A.1, A.2, A.3, A.7 and landscape plan; 2 that the 280 SF accessory structure shall be used solely for storage that the only utility to this structure shall be electricity and that any use other than storage shall require a special permit from the Planning Commission; 3. that the requirements of the Chief Building Official's memo (10/31/94) shall be met; and 4. that the project shall meet all the requirements of the Uniform building code and Uniform Fire Code as amended by the City of Burlingame. tD d CD v 00 W
