RESOLUTION NO, 56-94
RESOLUTION APPROVING NEGATIVE DECLARATION
AND SPECIAL PERMIT
RESOLVED, by the Planning Commission of the City of Burlingame that:
WHEREAS, a negative declaration has been proposed and application has been made for a special
permit for a 48 bed residential care facility for the elderly at 1733 California Drive, APN: 026-131-
190 ; pLqpgM owner: California Drive Partners, 1268 Balboa Avenue ; and
WHEREAS, said matters were heard by the Planning Commission of the City of Burlingame on
November 14. 1994 , at which time it reviewed and considered the staff report and all other written
materials and testimony presented at said hearing;
NOW, THEREFORE, it is RESOLVED and DETERMINED by this Planning Commission that:
1. On the basis of the Initial Study and the documents submitted and reviewed, and comments
received and addressed by this commission, it is hereby found that there is no substantial evidence that
the project set forth above will have a significant effect on the environment, and Negative Declaration
ND 474 P is hereby approved.
2. Said special permit is approved subject to the conditions set forth in Exhibit "A" attached
hereto. Findings for such Special Permit are as set forth in the minutes and recording of said meeting.
3. It is further directed that a certified copy of this resolution be recorded in the official
records of the County of San Mateo.

certify that the foregoing resolution was introduced and adopted at a regular meeting of the Planning
Commission held on the 14th day of November , 1994 , by the following vote:

Conditions of approval negative declaration and special permit
1733 CALIFORNIA DRIVE
effective NOVEMBER 21, 1994
1. that the project shall be built as shown on the plans submitted to the Planning
Department and date stamped September 22, 1994, Sheets Al-0 Site Plan, Sheet
Al-1 Site Plan (Illustration Only), Sheet A2-1 First Floor Plan, Sheet A2-2 Second
Floor Plan, and Sheet A3-1 Elevations;
2. that the conditions of the City Engineers' September 23, 1994 memo and the Fire
Marshals' September 24, 1994 memo shall be met;
3. that during demolition and construction all work must comply with Bay Area Air
Quality Management District regulations;
4. that the business shall be open 24 hours a day, seven days a week, with a
maximum of eight employees at any one time;
5. that documentation from a licensed acoustical engineer showing the maximum noise
level in any sleeping area shall not exceed 45 dBA, shall be included with the
building permit application, and shall be reviewed and accepted by the City
Engineer and Chief Building Inspector; and
6. that the project shall meet all the requirements of the Uniform Building and
Uniform Fire Codes as amended by the City of Burlingame.
