Date: 3.7.95 Margaret Monroe, City Planner RESOLUTION NO. 8-95 RESOLUTION APPROVING CATEGORICAL EXEMPTION SPECIAL PERMIT AND PARKING VARIANCE RESOLVED, by the Planning Commission of the City of Burlingame that: WHEREAS, a categorical exemption has been proposed and application has been made for a special permit to expand restaurant and a parking variance to increase floor area at 1108, 1110- 1120 Burlingame Avenue, zoned R-3, APN: 029-153-150 ; property owner: Lorenz and Louisa Kao, 1110 Burlingame Avenue ; and WHEREAS, said matters were heard by the Planning Commission of the City of Burlingame on February 27, 1995 , at which time it reviewed and considered the staff report and all other written materials and testimony presented at said hearing; NOW, THEREFORE, it is RESOLVED and DETERMINED by this Planning Commission that: 1. On the basis of the Initial Study and the documents submitted and reviewed, and comments received and addressed by this commission, it is hereby found that there is no substantial evidence that the project set forth above will have a significant effect on the environment, and categorical exemption Section: 15301 - Existing Facilities, Class 1: Repair, maintenance or minor alteration of existing public or private structures, including but not limited to: (d) restoration or rehabilitation of deteriorated or damaged structures . . . to meet current standards of public health and safety and (f) addition of safety devices . . . in conjunction with existing structures is hereby approved. 2. Said special permit and parking variance is approved subject to the conditions set forth in Exhibit "A" attached hereto. Findings for such variance and Special Permit are as set forth in the minutes and recording of said meeting. 3. It is further directed that a certified copy of this resolution be recorded in the official records of the County of San Mateo. v �H�klkMAN I, Mike Ellis , Secretary of the Planning Commission of the City of Burlingame, do hereby certify that the foregoing resolution was introduced and adopted at a regular meeting of the Planning Commission held on the 27th day of February , 1995 , by the following vote: AYES: COMMISSIONERS: DEAL, ELLIS, KEY, ,ALD GALLIGAN NOES: COMMISSIONERS: JACOBS AND MINK ABSENT: COMMISSIONERS: KELLY I SECRETARY EXHIBIT"A" Conditions of approval categorical exemption, special permit and parking variance 1108, 1110-1120 BURLWGAME AVENUE effective MARCH 6, 1995 1. that the project shall be built as shown on the plans submitted to the Planning Department and date stamped February 2, 1995 sheets A0.0, A0.1, ALL, A1.2, A1.3, A1.5 and A1.6 and sheets A1.0 and A1.4 date stamped February 17, 1995; 2. that there shall be only one food establishment on this site with a maximum of 4,368 GSF inside the building(3230 SF on the 1st floor)and 1685 SF used for seating in the outdoor patio area and that the basement area shall not contain any restaurant use including any office area for the restaurant business; 3. that condition#3 of the City Engineer's memo(1/19/95)shall be met; 4. that the conditions of the Building Official's memos dated 1/17/95 and the requirements of the Fire Marshal's memo dated 2/21/95 shall be met; 5. that the project shall meet all the requirements of the Uniform Building and Uniform Fire Codes as amended by the City of Burlingame.
