Date: 4.18.95 f*, Marg t Monroe, City Planner RESOLUTION NO . 12-95 RESOLUTION APPROVING CATEGORICAL EXEMPTION AND SPECIAL PERMIT RESOLVED , by the Planning Commission of the City of Burlingame that : WHEREAS , a categorical exemption has been proposed and application has been made for a special permit for auto repair at 1385 Suite B , Marsten Road, zoned M- 1 , APN : 026 - 123 - 030 ; property owner : Ferruccio Coruccini , 1490 Southdown Road, Hillsborough ; and WHEREAS , said matters were heard by the Planning Commission of the City of Burlingame on April 10 , 1995 , at which time it reviewed and considered the staff report and all other written materials and testimony presented at said hearing ; NOW , THEREFORE , it is RESOLVED and DETERMINED by this Planning Commission that : 1 . On the basis of the Initial Study and the documents submitted and reviewed , and comments received and addressed by this commission , it is hereby found that there is no substantial evidence that the project set forth above will have a significant effect on the environment , and categorical exemption per Section : 15301 - Existing Facilities , Class I ( a ) , Interior or exterior alterations involving such things as interior partitions , plumbing , and electrical conveyances is hereby approved . 2 . Said special permit is approved subject to the conditions set forth in Exhibit "A" attached hereto . Findings for such Special Permit are as set forth in the minutes and recording of said meeting . 3 . It is further directed that a certified copy of this resolution be recorded in the official records of the County of San Mateo . 41 C ' CHA N I , Mike Ellis Secretary of the Planning Commission of the City of Burlingame , do hereby certify that the foregoing resolution was introduced and adopted at a regular meeting of the Planning Commission held on the 10th day of April , 1995 , by the following vote : AYES : COMMISSIONERS : DEAL , ELLIS , JACOBS , KEY AND MINK NOES : COMMISSIONERS : KELLY AND GALLIGAN ABSENT : COMMISSIONERS : NONE SECRETARY EXHIBIT "A" Conditions of approval categorical exemption and special permit 1385 SUITE B, MARSTEN ROAD effective APRIL 17, 1995 1. that the auto repair shop shall be built as shown on the plans submitted to the Planning Department and date stamped March 30, 1995, Site Plan (1111 X 1711) and March 15, 1995 Floor Plan (11" X 1711) with the addition of one parking stall (10' X 201) designated and marked on the inside of this tenant space at a location approved by the City Engineer; 2. that the conditions of the Chief Building Inspectors' March 20, 1995 memo (remove stairway at restroom, and waiting room exit shall be independent of the repair area) and the Fire Marshals' March 13 and March 20, 1995 memos (auto repair work restricted to tuneups' and minor repairs with no auto body work or pulling of engines allowed and a separate exit from the waiting room, other than to the repair area shall be provided) shall be met; 3. that the business shall be open 8:00 A.M. to 5:30 P.M. Monday through Friday with a maximum of three employees including the proprietor, on site, at any one time; 4. that one full size parking space inside the building and a part of this tenant's space shall be designated and accessible at all times for customer parking and no repair shall be done on the public street or on adjacent public or private property; 5. that a building permit shall not be issued until the plans are corrected and approved by the City Engineer; 6. that a sign shall be placed at the entrance to the building indicating that additional customer parking is available inside, this sign shall be 2' X 3' directional sign and not be counted in the on-site signage; and 7. that the use and any improvements for the use shall meet all the requirements of the Uniform Building and Uniform Fire Codes as amended by the City of Burlingame.
