Date: 6.20.95 44L11— Margaiet Monroe, City Planner RESOLUTION NO . 15-95 RESOLUTION APPROVING NEGATIVE DECLARATION SPECIAL PERMIT RESOLVED , by the Planning Commission of the City of Burlingame that : WHEREAS , a negative declaration has been proposed and application has been made for a special permit for new construction of real estate offices at 1412-1416 Chapin Avenue zoned C-1 Subarea B APN • 029-121- 240 and 029-121-250 ; _property owner : Tito Bianchi c/aDeerfield Realty , 2150 North First Street #200 San Jose ; and WHEREAS , said matters were heard by the Planning Commission of the City of Burlingame on June 12 , 1995 , at which time it reviewed and considered the staff report and all other written materials and testimony presented at said hearing ; NOW! THEREFORE , it is RESOLVED and DETERMINED by this Planning Commission that : 1 . On the basis of the Initial Study and the documents submitted and reviewed , and comments received and addressed by this commission , it is hereby found that there is no substantial evidence that the project set forth above will have a significant effect on the environment , and Negative Declaration ND-476P is hereby approved . 2 . Said special permit is approved subject to the conditions set forth in Exhibit "A" attached hereto . Findings for such Special Permit are as set forth in the minutes and recording of said meeting . 3 . It is further directed that a certified copy of this resolution be recorded in the official records of the County of San Mateo . CHAT I , Pat Kelly Secretary of the Planning Commission of the City of Burlingame , do hereby certify that the foregoing resolution was introduced and adopted at a regular meeting of the Planning Commission held on the 12th day of June , 1995 , by the following vote : AYES : COMMISSIONERS : DEAL , ELLIS , GALLIGAN , MINK AND JACOBS NOES : COMMISSIONERS : NONE ABSENT : COMMISSIONERS : KELLY AND KEY SECRETARY EXHIBIT "A" Conditions of approval negative declaration and special permit 1412-1416 CHAPIN AVENUE effective JUNE 19, 1995 1. that the 5154 SF, first floor office area shall built as shown on the plans submitted to the Planning Department and dated May 30, 1995, sheets 1, 2, 3 & L1, and shall be used for a real estate office which shall have a maximum of 36 full-time and part-time agents and 3 full-time staff; 2. that the real estate use shall not be extended to the second floor (4,490 SF) of this building nor shall a separate real estate business be located on the second floor of this building without amendment to this use permit nor shall the number of full-time and part-time agents in this real estate business be increased without an amendment to this use permit; 3. that this real estate business shall operate seven days a week from 9:00 A.M. to 6:00 P.M. and that the on-site parking shall be retained for the employees on site and their clients/customers without any charge to users or businesses; and shall never be sublet to any other business; 4. that the sign(s) proposed for this site shall require a separate sign permit from the Planning Department prior to installation; 5. that the lot combination map shall be filed and approved prior to the issuance of a building permit for this project; and 6. that all construction shall comply with the Uniform Building and Uniform Fire Codes as amended by the City of Burlingame.
