Date: 7.25.95 Margar t Monroe, City Planner RESOLUTION NO. 16-95 RESOLUTION APPROVING CATEGORICAL EXEMPTION SPECIAL PERMIT, SIDE & REAR SETBACK VARIANCES AND PARKING VARIANCE RESOLVED, by the Planning Commission of the City of Burlingame that: WHEREAS, a categorical exemption has been proposed and application has been made for a special permit for a window within 10'-0" of rear property line at 309 Bayswater Avenue. zoned R-1. APN: 029-302-030 ; property owner: Jeffrey and Barbara Moore, 309 Bayswater Avenue ; and WHEREAS, said matters were heard by the Planning Commission of the City of Burlingame on June 26. 1995 , at which time it reviewed and considered the staff report and all other written materials and testimony presented at said hearing; NOW, THEREFORE, it is RESOLVED and DETERMINED by this Planning Commission that: 1. On the basis of the Initial Study and the documents submitted and reviewed, and comments received and addressed by this commission, it is hereby found that there is no substantial evidence that the project set forth above will have a significant effect on the environment, and categorical exemption per Section: 15303 - Class 3 - construction and location of limited numbers of new, small facilities or structures including (e) accessory (appurtenant) structures including garages, carports, patios, swimming pools and fences is hereby approved. 2. Said special permits, front setback & lot coverage variances are approved subject to the conditions set forth in Exhibit "A" attached hereto. Findings for such variances and special permits are as set forth in the minutes and recording of said meeting. 3. It is further directed that a certified copy of this resolution be recorded in the official records of the County of San Mateo. CHAIRMAN I, Karen KU , Secretary of the Planning Commission of the City of Burlingame, do hereby certify that the foregoing resolution was introduced and adopted at a regular meeting of the Planning Commission held on the 26th day of June , 1995 , by the following vote: AYES: COMMISSIONERS: ELLIS, GALLIGAN, JACOBS, KEY AND MINK NOES: COMMISSIONERS: NONE ABSENT: COMMISSIONERS: DEAL SECRETARY EXHIBIT "A" Conditions of approval categorical exemption and special permit 309 BAYSWATER AVENUE effective JULY 6, 1995 1. that the project shall be built as shown on the plans submitted to the Planning Department date stamped June 16, 1995, sheets 1 and 2 with the interior garage dimensions of not less than 10'-0 wide and 20'-0" deep without the carport; and 2. that the project shall meet all the requirements of the Uniform Building and Uniform Fire Codes as amended by the City of Burlingame.
