Date: 10.03.95 Margaret Monroe, City Planner w r RESOLUTION NO.25-95 RESOLUTION APPROVING CATEGORICAL EXEMPTION AND SPECIAL PERMIT RESOLVED, by the Planning Commission of the City of Burlingame that: WHEREAS, a categorical exemption has been proposed and application has been made for a special permit for classes/tutoring at 1860 El Camino Real, Suite #308, APN: 025-150-210 ; property owner: Marco Chavez, 1860 El Camino Real, #315 ; and WHEREAS, said matters were heard by the Planning Commission of the City of Burlingame on September 26, 1995 , at which time it reviewed and considered the staff report and all other written materials and testimony presented at said hearing; NOW, THEREFORE, it is RESOLVED and DETERMINED by this Planning Commission that: 1. On the basis of the Initial Study and the documents submitted and reviewed, and comments received and addressed by this commission, it is hereby found that there is no substantial evidence that the project set forth above will have a significant effect on the environment, and categorical exemption per Section: 15301 -Existing Facilities, Class 1(a) , Interior or exterior alterations involving such things as interior partitions, plumbing, and electrical conveniences is hereby approved. 2. Said special permit is approved subject to the conditions set forth in Exhibit "A" attached hereto. Findings for such Special Permit are as set forth in the minutes and recording of said meeting. 1 3. It is further directed that a certified copy of this resolution be recorded in the official records of the County of San Mateo. CHAIRMXN ./ I, Karen Key-, Secretary of the Planning Commission of the City of Burlingame, do hereby certify that the foregoing resolution was introduced and adopted at a regular meeting of the Planning Commission held on the 26th day of September , 1995 , by the following vote: AYES: COMMISSIONERS: DEAL, ELLIS, GALLIGAN, KEY, MINK, WELLFORD AND JACOBS NOES: COMMISSIONERS: NONE ABSENT: COMMISSIONERS: NONE SECRETARY EXHIBIT"A" Conditions of approval categorical exemption and special permit 1860 EL CAMINO REAL, SUITE#308 effective OCTOBER 2, 1995 1. that the business shall occupy 600 GSF in Suite #308, as shown on the plans submitted to the Planning Department and date stamped August 14, 1995, Third Floor Plan(81/2"X 11")and Site Plan and Parking Plan(81/2"X 14"); 2. that the business shall be open 3:00 p.m.to 5:00 p.m.Monday through Friday and 9:00 a.m.to 5:00 p.m.on Saturday with some occasional weekday,evening classes from 5:00 p.m. to 7:00 p.m., with a maximum of three employees including the proprietor, on site, at any one time; 3. that there will be no more than two(2)teachers and eight(8)students at any one time and that an amendment to this special permit shall be necessary if any change in the number of students, number of teachers, size of area occupied, or any other expansion occurs; and 4. that the use and any improvements for the use shall receive a retrgactive building permit and shall meet all the requirements of the Uniform Building and Uniform Fire Codes as amended by the City of Burlingame.
