Date: 12.5.95 M g r6t Monroe, City Planner RESOLUTION NO. 28-95 RESOLUTION APPROVING CATEGORICAL EXEMPTION SPECIAL PERMIT AND VARIANCE RESOLVED, by the Planning Commission of the City of Burlingame that: WHEREAS, a categorical exemption has been proposed and application has been made for two special permits and a side setback variance for a new detached single car garage at 328 Chapin Lane. zoned R-1. APN: 026-123-060 ; property owner: George Montgomery, 328 Chapin Lane ; and WHEREAS, said matters were heard by the Planning Commission of the City of Burlingame on November 27, 1995 , at which time it reviewed and considered the staff report and all other written materials and testimony presented at said hearing; NOW, THEREFORE, it is RESOLVED and DETERMINED by this Planning Commission that: 1. On the basis of the Initial Study and the documents submitted and reviewed, and comments received and addressed by this commission, it is hereby found that there is no substantial evidence that the project set forth above will have a significant effect on the environment, and categorical exemption per Section: 15303 -Existing Facilities, Class 3(e)-Accessory (appurtenant) structures including garages, carports, patios, swimming pools and fences is hereby approved. 2. Said special permits and variance is approved subject to the conditions set forth in Exhibit "A" attached hereto. Findings for such variance and Special Permits are as set forth in the minutes and recording of said meeting. 3. It is further directed that a certified copy of this resolution be recorded in the official records of the County of San Mateo. CHAIRMAN/ •' I, Karen Key-, Secretary of the Planning Commission of the City of Burlingame, do hereby certify that the foregoing resolution was introduced and adopted at a regular meeting of the Planning Commission held on the 27th day of November , 1995 , by the following vote: AYES: COMMISSIONERS: DEAL, ELLIS, GALLIGAN, KEY, WELLFORD AND JACOBS NOES: COMMISSIONERS: MINK ABSENT: COMMISSIONERS: NONE SECRETARY EXHIBIT "A" Conditions of approval categorical exemption, special permit and variance 328 CHAPIN AVENUE effective DECEMBER 4, 1995 1. that the garage shall be built as shown on the plans submitted to the Planning Department and date stamped October 11, 1995 Sheets A0, Al, A2, A3; and that there shall be at least a 4' separation between the eaves of the garage and the closest portion of the house; 2. that the toilet in the detached garage shall be used in conjunction with the future pool use only and that the new detached garage shall never be used as an accessory living unit or for any purposes other than a detached garage with toilet and changing room; 3. that the exterior shower shall not be enclosed without an amendment to this use permit; 4. that no structure shall ever be constructed to connect the garage to the house, except for a fence built to current Planning, Building and Fire code requirements; and 5. that the project shall meet all the requirements of the Uniform building and Uniform Fire Codes as amended by the City of Burlingame.
