Date: 1.3.96 Margaret Monroe, City Planner RESOLUTION NO.� � RESOLUTION APPROVING NEGATIVE DECLARATION CONDOMINIUM PERMIT AND LANDSCAPING VARIANCE RESOLVED, by the Planning Commission of the City of Burlingame that: WHEREAS, a negative declaration has been proposed and application has been made for a condominium permit for a new three story, 12 unit residential condominium with underground garage at 550 El Camino Real zoned R-3 APN: 029-111-250 ; property owner: Stuart B. Aronoff, 2659 Pierce Street, San Francisco ; and WHEREAS, said matters were heard by the Planning Commission of the City of Burlingame on December 11. 1995 , at which time it reviewed and considered the staff report and all other written materials and testimony presented at said hearing; NOW, THEREFORE, it is RESOLVED and DETERMINED by this Planning Commission that: 1. On the basis of the Initial Study and the documents submitted and reviewed, and comments received and addressed by this commission, it is hereby found that there is no substantial evidence that the project set forth above will have a significant effect on the environment, and Negative Declaration Refer to new Negative Declaration 476-P and previous negative declaration ND 463-P attached to this staff report, is hereby approved. 2. Said condominium permit and landscaping variance is approved subject to the conditions set forth in Exhibit "A" attached hereto. Findings for such condominium permit and landscaping variance are as set forth in the minutes and recording of said meeting. 3. It is further directed that a certified copy of this resolution be recorded in the official records of the County of San Mateo. ni,l,t. CHAIRMAN I, Karen Key , Secretary of the Planning Commission of the City of Burlingame, do hereby certify that the foregoing resolution was introduced and adopted at a regular meeting of the Planning Commission held on the 11th day of December , 1995 , by the following vote: AYES: COMMISSIONERS: DEAL, ELLIS, GALLIGAN, KEY, MINK AND WELLFORD NOES: COMMISSIONERS: NONE ABSENT: COMMIS:-IONERS: JACOBS 7 SECRETARY �,. a.• EXHIBIT "A" Conditions of approval negative declaration condominium permit and landscaping variance 550 EL CAMINO REAL effective JANUARY 2, 1996 1 . that the project shall be built as shown on the plans submitted to the Planning Department and date stamped November 17, 1995 , Sheets DD1 , DD2, DD3 & DD4; 2 . that the conditions set forth in the Fire Marshal's July 30, 1993 memo, the City Engineer' s August 17, 1993 memo and the Park Director's July 30 and August 2, 1993 memo and the Senior Building Official' s November 20, 1995 memo shall be met; 3 . that a security system with and intercom to each unit shall be provided for access to the designated guest parking in the garage and a mirror shall be installed half way down the garage ramp for vehicles exiting the garage to see on coming cars; 4. that a total of 3 guest parking stalls shall be designated and marked on the final map and plans, and not assigned to any unit, but shall be owned and maintained by the condominium association; 5 . that the final inspection shall be completed and a certificate of occupancy issued before the close of escrow on the sale of each unit; 6. that the developer shall provide the initial purchaser of each unit and to the board of directors of the condominium association , and owner purchaser manual which shall contain the name and address of all contractors who perform work on the project, copies of all warranties or guaranties of appliances and fixtures and the estimated life expectancy of all depreciable component parts of the property, including but not limited to the roof, painting, common area carpets, drapes and furniture; 7. that the parking garage shall be designed to city standards and shall be managed and maintained by the condominium association with one space assigned to each unit, three (3) designated guest parking spaces and the remaining spaces rented for a nominal fee by the association only to the residents with two cars; and no portion of the parking area and aisles shall be converted to any other use than parking or used for any support activity s«ch as storage unit, utilities or other non-parking use; 8 . that the furnaces and water heaters shall be shown in a legal compartment outside of the required parking and landscaping and in conformance with zoning and Uniform Building Code and Uniform Fire Code requirements before a building permit is issued; EXHIBIT "A" Conditions of approval negative declaration condominium permit and landscaping variance 550 EL CAMINO REAL effective JANUARY 2, 1996 page -2- 9. that for the protection of pedestrians a silent auto warning system shall be installed at the ingress/egress area to the underground parking garage; 10. that the location of trash receptacles shall be approved by the City Engineer; 11. that the exhaust system shafts for the underground garage shall be located to avoid landscaping and walkways; 12. that the maximum elevation at the top of the roof ridge and parapet wall shall not exceed elevation 74.33' (74'-4") as measured from the average elevation at the top of the curb along El Camino Real for a maximum height of 35'-0", and that the top of each floor and final roof ridge shall be surveyed and approved by the City Engineer as the framing proceeds and prior to final framing and roofing inspections. Should any framing exceed the stated elevation at any point it shall be removed or adjusted so that the final height of the structure with roof shall not exceed the above stated specifications; and 13. that the project including egress and access requirements, shall meet all the requirements of the municipal code and Uniform Building and Uniform Fire Codes as amended by the City of Burlingame. Question: Is the circular driveway needed? Answer: Architect's letter of August 11, 1993 gives reasons for this driveway. It may help reduce accident potential if a split driveway is utilized as planned one in and one out. 2. Question: What is the assumption of 5 trips per day based on? Answer: The July 10, 1993 "Residential Condominium Trip Generation" study from the Traffic Engineer RKH indicates that nationally recognized trip generation studies were the basis of the computations. CONDOMINIUM PERMIT I have reviewed the August 2, 1993 resubmittal. I have the following conditions that should be attached to any approvals. I GENERAL• 1. All roof and site drainage shall go to street by gravity. Show direction of drainage on adjacent property to confirm that no drainage enters this site or else that drainage needs to be included in the on-site system. 2. Confirm prior to issuance of any Building Permit that the proposed drainage system meets the State Department of Transportation's approval. 3. Provide the required seven foot (71) minimum clearances at parking garage floor areas. Provide room for all pipings, ducts and fire sprinklers. Disabled parking shall have access and parking area at eight feet two inches (81211) clear. -1- 4 . All utilities to this site shall be installed underground. 5 . New curb, gutter and sidewalk fronting this site shall be designed by a civil engineer, approved by the City Engineer, and installed by this development. II SITE LANDSCAPES AND PLANS: 1. Caltrans must review and approve all E1 Camino Real accesses. They have had major questions in the past for double driveways as well as spacing between a new driveway and an adjacent property' s driveway. Applicant must receive approval prior to issuance of a Building Permit. 2 . Transformer is not shown on site? All transformers needed for this project will be conditioned to be installed on this site either underground or behind the front setback. 3 . All irrigation systems and planting shall follow City's water conservation guidelines. 4 . Permanent signs and markings shall be placed and maintained indicating entrance and exit directions on the circular driveway. III PARKING• 1. Underground and at-grade parking slab elevations and slopes shall be shown on Final Plans. Maximum slope in any parking space is 5%. Finished floor elevations and drainage pattern shall also be shown. 2 . All on site drainage inlets or the sump pump basin for the underground garage with a petroleum absorbent system for all drainage flows from the automobile parking areas. 3 . Columns that are on the side of parking spaces are to be clear of vehicle' s side door access and should be at least two feet (21 ) clear of the rear of the stalls to facilitate maneuvering. 4. The underground garage walls clearances at property line shall be calculated by the Civil Engineer or Surveyor and shown on Building Permit Plans. Show how the walls are going to be constructed without easements on adjacent property? Final plans shall show how excavation is to be made on property with room and for back of wall drainage. 5 . Plans shall show a driveway profile with a 2% slope from top of curb (6" high minimum) to back of sidewalk and transition to a high point, on site or at property line, at 12" above flow line of street. Transitions at top of driveway and at bottom are required for approval of the City Engineer. IV ARCHITECTURAL PLANS: 1. Final Plans shall provide all unit dimensions and exterior dimensions. -2- 2 . The Design of the trashroom shall indicate size of receptacles, including receptacles for recycling. Confirm sizes needed with BFI . 3 . The Parking Level Plan and First Floor (Site) Plans , shall show adjacent site and street elevations for reference . 4 . Elevator sump drainage shall go to sanitary sewer and is to be separate from groundwater system which shall go to the storm drainage system. 5 . All building sections shall show site elevations and adjacent site elevations and show them to scale to give the relationship. 6 . Individual unit climate controls as well as separate shut-offs for gas , electric and water are required. Frank C.
