Date: 12.04.01 1 Margar t Monroe, Vity Planner l�`� RESOLUTION APPROVING CATEGORICAL EXEMPTION, AND CONDITIONAL USE APPLICATION RESOLUTION—104-2001 RESOLVED,by the Planning Commission of the City of Burlingame that: WHEREAS, a categorical exemption has been proposed and application has been made for a conditional use permit for non-automobile related retail sales in Subarea D of the Burlingame Avenue Commercial Area at 210 California Drive,zoned C-2,Isaac and Evelyn Baumelgruen,property owners,APN: 029-213-030; WHEREAS, said matters were heard by the Planning Commission of the City of Burlingame on November 26, 2001, at which time it reviewed and considered the staff report and all other written materials and testimony presented at said hearing; NOW, THEREFORE, it is RESOLVED and DETERMINED by this Planning Commission that: 1. On the basis of the Initial Study and the documents submitted and reviewed, and comments received and addressed by this commission, it is hereby found that there is no substantial evidence that the project set forth above will have a significant effect on the environment, and categorical exemption,per CEQA Article 19. Categorically Exempt per Section: 15303—Class I-the operation repair,maintenance,or minor alteration of existing public or private structures, facilities,mechanical equipment, or topographical features, involving negligible or no expansion of use beyond that previously existing including but not limited to (a) interior or exterior alternations involving such things as interior partitions, plumbing, and electrical conveyances. 2. Said categorical exemption and conditional use permit are approved,subject to the conditions set forth in Exhibit "A" attached hereto. Findings for such conditional use permit are as set forth in the minutes and recording of said meeting. 3. It is further directed that a certified copy of this resolution be recorded in the official records of the County of San Mateo. CHAIRMAN I, Ralph Osterling, Acting Secretary of the Planning Commission of the City of Burlingame, do hereby certify that the foregoing resolution was introduced and adopted at a regular meeting of the Planning Commission held on the 26th day of November, 2001 ,by the following vote: AYES: COMMISSIONERS: Auran,Keighran,Key, Mink, Osterling and Vistica NOES: COMMISSIONERS: NONE ABSENT: COMMISSIONERS: Bojues 111111111111IIIIIIIIIIIIIIIIIIIIIIIIIIIIIIIIIIIIIIIIIII ©59/21 Page:ore oz oo�P�2� 4ACGE RET EXHIBIT "A" Conditions of approval for categorical exemption and conditional use permit. 210 California Drive effective December 3, 2001 1. that the project shall be built as shown on the plans submitted to the Planning Department and date stamped October 26, 2001; and 2. that the 1,750 SF tenant space at 210 California Drive shall be used as a retail clothing store, any expansion of the leased space,number of employees exceeding 3 on this site at one time, and/or a change to the hours of operation from 10:00 a.m. to 7:00 p.m. Monday through Friday, and 11:00 a.m. to 6:00 p.m. Saturday and Sunday shall be brought to the Burlingame Planning Commission for approval; and 3. that the project shall meet all the requirements of the California Building and Uniform Fire Codes, 1998 edition, as amended by the City of Burlingame.
