Date: 02.14.02 n a LkL)�Jn Marga t Monroe, City Planner RESOLUTION APPROVING CATEGORICAL EXEMPTION AND DESIGN REVIEW AMENDMENT RESOLUTION-12-2002 RESOLVED, by the Planning Commission of the City of Burlingame that: WHEREAS, a categorical exemption has been proposed and application has been made for design review amendment to an approved first floor remodel and second floor addition at 2115 Poppy Drive, zoned R-1, Lawrence Viola,property owner, APN: 027-162-160; WHEREAS, said matters were heard by the Planning Commission of the City of Burlingame on January 28, 2002, at which time it reviewed and considered the staff report and all other written materials and testimony presented at said hearing; NOW, THEREFORE, it is RESOLVED and DETERMINED by this Planning Commission that: 1. On the basis of the Initial Study and the documents submitted and reviewed, and comments received and addressed by this commission, it is hereby found that there is no substantial evidence that the project set forth above will have a significant effect on the environment, and categorical exemption, per CEQA Article 19. Categorically Exempt per Section: 15301 Class 1 - (e) additions to existing structures provided the addition will not result in an increase of more than 50% of the floor area of the structures before the addition, is hereby approved. 2. Said design review amendment is approved, subject to the conditions set forth in Exhibit "A" attached hereto. Findings for such design review amendment are as set forth in the minutes and recording of said meeting. 3. It is further directed that a certified copy of this resolution be recorded in the official records of the County of San Mateo. ACWAIRMAN I, Joseph Bojues , Secretary of the Planning Commission of the City of Burlingame, do hereby certify that the foregoing resolution was introduced and adopted at a regular meeting of the Planning Commission held on the 28`h day of JanuM , 2002 ,by the following vote: AYES: COMMISSIONERS: AURAN, BOJUES, BROWNRIGG, KEIGHRAN, KEELE, OSTERLING and VISTICA NOES: COMMISSIONERS: NONE ABSENT: COMMISSIONERS: NONE SEC T Y EXHIBIT "A" Conditions of approval for categorical exemption and design review amendment. 2115 Poppy Drive effective February 4, 2002 1. that the project shall be built as shown on the plans submitted to the Planning Department date stamped January 17, 2002, sheets A-1 through A-3 (proposed plans)which show revisions from the previously approved plans limited to a new 7'-5"x 7'-10"balcony on the second floor off the master bedroom and a new 3' x 6'-8" door from the master bedroom to the deck; and the balcony rail design as shown on sheet A-3 (proposed plans) date stamped January 17, 2002; 2. that any changes to the footprint or floor area of the building shall require and amendment to this permit; 3. that any changes to the size or envelope of the project,which would include adding or enlarging a dormer(s),moving or changing windows and architectural features or changing the roof height or pitch, shall be subject to design review; 4. that the conditions of the City Engineer's December 30, 1998, memo and the Chief Building Official's January 22, 2002, memo shall be met; 5. that the project shall meet all the requirements of the California Building Code and California Fire Code, 1998 edition, as amended by the City of Burlingame; 6. that all work on the property must be done in accordance with construction hours set forth in Burlingame Municipal Code 18.07.130, regulating hours of construction from 7:00 a.m. to 7:00 p.m. on weekdays, 9:00 a.m. and 6:00 p.m. on Saturdays, and 10:00 a.m. and 6:00 p.m. on Sundays and holidays; and 7. that no vehicles shall be parked within the front yard(between the house and the front property line) except in the driveway at anytime.
