FROM THE FLOOR Speakers may address the Commission concerning any matter over which the Commission has jurisdiction or of which it may take cognizance that is not on the agenda. Additional public comments on agenda action items will be heard when the Commission takes up those items. The Ralph M. Brown Act (the State local agency open meeting law) prohibits the Commission from acting on any matter that is not on the agenda. Speakers are asked to fill out a "request to speak" card located on the table by the door and hand it to staff, although provision of name, address or other identifying information is optional. Speakers are limited to three minutes each, although the Commission may adjust the time limit in light of the number of anticipated speakers. V. OLD BUSINESS 1) 2016 Business Landscape Award VI. BURLINGAME BEAUTIFICATION COMMISSION April 7,2016 The regularly scheduled meeting of the Beautification Commission was called to order at 6:30 pm by Commissioner McQuaide. ROLL CALL Present: Commissioner McQuaide, Hunt, Hinckle, Kirchner and Kearney Absent: None Staff: P & R Director Glomstad, City Arborist Disco and City Attorney Kathleen Kane MINUTES Kearney made a motion to approve March 3, 2016 minutes with the correction to the Residential Landscape Award date for 2017. The motion was seconded by Hinckle and unanimously approved. CORRESPONDENCE None PUBLIC COMMENT None NEW BUSINESS 1. Appeal of 1480 Highway Road Permit Director Glomstad read staff report provided and Arborist Disco explained process of permit issuance, approval timeline and qualifications for removal. Nina and Anthony Wang, appellants spoke to the Commission regarding their appeal based on privacy and protection provided by the tree. Melinda Saunders, neighbor, spoke on behalf of the neighborhood impact regarding the proposed removal of the tree. Sarah Hillhouse, Coldwell Banker Realtor, spoke regarding property value the tree provides to homeowners. Arborist Disco answered Commissioners questions regarding health of tree, replanting of existing area, structure and safety of tree, possible replacement issues and pruning of existing tree regarding root system. Commissioner Hinckle made a motion to uphold the appeal and not allow removal of the tree at this time. The findings to support this motion include the condition that Mr. and Mrs. Wang have a certified arborist write a proposal to have the tree significantly pruned on their side of the fence in order to balance the canopy to compensate for the removal of the roots for the new driveway, the work will occur within 8 weeks or the appeal will be denied, the expense will be the responsibility of the Wang's, and the proposal must be reviewed by the City Arborist before a tree company performs any work. The motion was seconded by Commissioner Hunt. Motion passed 4-1. 2. Tree Ordinance Revisions City Attorney Kathleen Kane gave an overview of the Tree Ordinance study session. She shared with Commissioners the Council presentation and protections of private/city trees. Items included the need to streamline the appeal process between Planning and Beautification Commissions, and build a better review/appeal process for information between both Commissions requiring more information shared during the process. Kathleen handed out a questionnaire to help facilitate the discussion. The contents included what type of trees to protect, how to determine proper replacement tree species, who should be allowed to appeal, and the types of penalties. City Attorney Kane asked that all Commissioners provide answers and submit them to her. OLD BUSINESS 1. 2016 Business Landscape Award - Timeline Commissioner Hinckle reported no updates. REPORTS 1. Parks and Recreation Director Glomstad None 2. City Arborist Removal of Carrotwood trees and replacement of Crepe Myrtles on Broadway is almost complete. Spring planting of 85 trees will take place in two weeks. 3. Commissioner Kirchner None 4. Commissioner Hinckle None 5. Commissioner McQuaide None 6. Commissioner Hunt None 7. Commissioner Kearney El Camino Elm trees are coming along nicely. The next Beautification Commission meeting is May 3, 2016. There being no further business, the meeting adjourned at 8:33pm.
