HomeMy WebLinkAboutReso - CC - 077-1966WJML:RMH:mf ll/l/66 15C RESOLUTION OF INTENTION NO. 77-66 A RESOLUTION OF INTENTION TO VACATE SANITARY SEWER EASEMENT BAYSIDE IMPROVEMENT DISTRICT RESOLVED, by the City Council of the City of Burlingame as follows: 1. This Council hereby elects to take proceedings to vacate a certain sanitary sewer easement situated in the City of Burlingame, County of San Mateo, pursuant to the provisions of Sections 50430 through 50445 of the Government Code of the State of California. 2. The public interest and convenience require, and it is the intention of said Council to order the vacation of that certain sanitary sewer easement situated in the City of Burlingame, County of San Mateo, more particularly described in Exhibit "A" hereto attached and by reference made a part hereof. A map showing the easement proposed to be vacated is on file in the office of the City Clerk. 3. Notice is hereby given that Monday, the 5th day of 8:00 December , 1966, at gx3M o'clock P.M., at the Council Cham- bers of the Council of said City, City Hall, Burlingame, California, is hereby fixed as the time and place when and where any and all persons interested in or having any objections to the proposed vaca- tion of said easement may appear before said Council and show.cause why said proposed vacation should not be carried out in accordance with this Resolution of Intention. 4. The Clerk of said City shall cause this Resolution of Inten- tion to be published once in the Burlingame Advance Star, a news- paper of general circulation published in said City, and be posted in three (3) public places 'in the City of Burlingame. 5. Notices of the proposed vacation of said easement shall be conspicuously posted along the line of the easement proposed to be vacated. Said notices shall be posted not more than three hundred feet apart, but at least three shall be posted. Said notices shall state the passage of this Resolution of Intention and the time and place of the hearing. 6. This Resolution shall take effect immediately upon its adoption. IMAMwm� is -2- EXHIBIT "A" DESCRIPTION OF EASEMENT TO BE ABANDONED SANITARY SEWER EASEMENT Those certain parcels of land situate in the City of Burlingame, County of San Mateo, State of California, more parti- cularly described as follows: A strip of land 10 feet wide lying 5.00 feet on each side of the following described line: Commencing at a manhole on an existing sewer line dis- tant S 320 41B 24" E, 41.30 feet from the westerly end of the course described as IN 770 451 E, 219.60 feet' in that certain Deed to the State of California recorded August 31, 1943 in Volume 1076 at page 343, San Mateo County Records; thence from said point of commencement S 730 451 E, 297.39 feet; thence S 75 21" 17" E, 474.29 feet; thence N 55° 53" 43" E, 41.46 feet to a point on the southwesterly line of that certain parcel of land conveyed to the City of Burlin- game by Deed recorded December 7, 1934, in Volume 636 at page 482, Official Records of San Mateo County; said point being distant along said southwesterly line from a tangent that bears S 590 221 10" E. along a curve to the left with a radius of 3987.50 feet, through an angle of 00 05' 44.8" a distance of 6.67 feet from the westerly corner of said parcel to the City of Burlingame.
