WHEREAS, the CITY OF BUfMINGAMM and BAN MATEO COUNTY
GARBAGE MT4ANY, a corporation, hereinafter referred to as
"COMPANY", entered into an agreement dated September 1, 1957,
wherein COM12ANY was granted an exclusive contract, right and pri-
vilege to collect and dispose of all garbage, rubbish and waste
matter accumulated in the CITY OF BURIINGr-1-TE; and
WHEREAS, said agreement is in full force and effect; and
WHEREAS, Paragraph 18 of said agreement provides in part
that in the event that there shall have been a rise of at least
five (5) percent in the cost of collection, removal and disposal
of such garbage, CO,L'??\Y shall notify this Council of its inten-
tion to request a raise in rates and shall state the ;proposed new
rate schedule, and provides, further, that if this Council finds
and determines that the proposed -rates are fair to the residents
of the CITY, and are required to provide COI➢'ANY with a fair re-
turn, it shall, within thirty(30) days after receipt of such
notice, authorize such increase L-y the adoption of a resolution
amending said agreement to provide for such increase and that the
new.rate schedule shall become effective commencing with the cal-
endar month next succeeding the adoption of such resolution; and
WHEREAS, by its letter dated November 15, 1967, together
rrlth enclosures, addressed to the City Manager, COMPANY asserts
that there has been a rise in excess of five (5) percent in the
cost of collection, removal and disposal of garbage since _-ae date
of said agreement and has submitted a proposed increase in rates
-or Council's finding and determination as to their fairness to
zhe residents of the CITY OF BURLINGAME; and

WMRE..3, in said letter and its enclosures COMPANY re-
quests that said agreement be modified to substitute zie "Opera-
ting Ratio" method for the "Fair Return" method in determining
future rate increases, if any.
NOW, TF.ERE, FORE , IT IS HEREBY FOUND, OU=RED AND DETER-
MINED as follows:
1. There has been a rise of at least five (5) percent
in the cost of collection, -removal and disposal of garbage in the
CITY OF BURLINC 1`E since September 1, 1957.
Z, COMPANY has notified the Council of such rise in
such costs in the manner required in said agreement.
3. COMPANY has submitted to the Council its proposed
increased monthly rates, which are hereinafter set forth and
which rates, in view of the increase in costs of collection, are
fair to the residents of the CITY OF BURLINGAIu E.
4. In accordance with the provisions of Paragraph 18
of said agreement, dated September 1, 1957, and at the request of
COMPANY, Paragraph 7 thereof is amended to read and provide as
set forth in Exhibit "A" attached hereto and incorporated 'herein.
5, The schedule of monthly rates set forth in Exhibit
"A" shall be effective on January 1, 1968.
6. The City Manager be, and he is hereby, authorized
and directed, for and on behalf of the CITY, to execute a modifi-
cation of said agreement substituting the "Operating Ratio;'
method for the "Fair Return" method in determining future rate
increases, if any, and the City Clerk be, and he is hereby,
authorized and directed to attest his signature and to affix his
seal.

Burlingame, do hereby certify that the foregoing resolution was
introduced at a regular meeting of the City Council held on the
18th day of December, 1967, and adopted thereafter by the follow-
ing vote:
AYES: Councilmen: Diederichsen, George, Martin.
NOES: Councilmen: None
Absent Councilmen: Crosby, Johnson.

Rate Schedule
The following schedule of monthly rates as to collection
of garbage shall apply:

Once -Per -Week Service

Collections of over 40 gallons shall be paid for at the
rate of four and one-half cents (4-1/2¢) per gallon.
The aforesaid rates shall apply for weekly service. In
the event that two collections per week are made, the rate shall
be double that for weekly collections. In the event that more tha
two collections per week are made, the rate shall be four and one-
half cents (4-1/20) per gallon.
All rates herein charged are for collections at the
ground level, and COMPANY shall not be required to ::. Le collec-
tions at other than said level; provided that CO1Q.AM shall at all
times be required to furnish back -yard service.
The rates herein provided may be changed for good cause
as hereinafter set forth by order of the City Council, on applica-
tion by the C01v2ANY.
