AMENDING RESOLUTION NO. 64-68 ENTITLED
"DECLARING INTENTION TO PARTICIPATE IN
FORMING A COOPERATIVE LIBRARY SYSTEM"
ADOPTED SEPTEMBER 3, 1968
RESOLVED, by the City Council of the City of Burlingame,
California, that Resolution No. 64-68 entitled "Declaring
Intention to Participate in Forming a Cooperative Library System"
adopted September 3, 1968 be, and the same is hereby amended to
read and to provide as follows:
WHEREAS, by the establishment of a cooperative library
system formed of the various existing, independent city library
systems in the County of San Mateo, the needs of the public will j
be more fully satisfied and library services improved for the
benefit of the people of Burlingame, library patrons residing
within its service area, and the participating cities; and
WHEREAS, by the establishment of such a cooperative
system, savings can be effectuated in the cost of performing
certain operations and providing certain services without loss
of local control and jurisdiction over material and services
within the Burlingame Library System.

NOW, THEREFORE, IT IS HEREBY DETERMINED AND ORDERED
that:
1. This Council hereby approved a plan of service for
the Peninsula Library System, which plan is hereby incorporated
and becomes part of this resolution.
2. The public interest and convenience will be served by
participating in a cooperative library system and this Council
does hereby declare its intent to enter into a Joint Exercise
of Powers Agreement, pursuant to Sections 6500 et seq. of the f
Government Code, for the establishment of a cooperative library
system, subject to the following conditions:
(a) The terms of any agreement shall be subject to full
and complete review by this Council and this resolution shall
not be construed to obligate the City of Burlingame to execute
such agreement.
(b) Any agreement prepared shall expressly provide that
the City of Burlingame shall retain full, complete and exclusive
control over any and all materials selected for its libraries
and over the personnel of the library staff.
(c) The agreement shall provide that the City of
Burlingame shall incur no financial obligations and that the
expense of establishing the cooperative system shall be borne
by the establishment and/or per capita grants from the State
of California.
(d) The agreement shall be for a trial period not to
exceed two (2) years and shall provide that the City of
Burlingame may withdraw from the system on a 30-day notice.
(e) The agreement shall provide that each library
participating is responsible to the lending library for any
books issued to its card holders.
2. The City Librarian be, and hereby is ordered, to
proceed with the negotiation of the agreement with other
independent city library systems in the County of San Mateo,
and to make such applications and prepare such statements of
eligibility and a Plan of Service as may be necessary to
secure a grant from the State of California pursuant to
Sections 27144 et seq. of the Education Code.

'introduced at a regular meeting of the City Council held on
the 21st day of October 1968, and adopted thereafter
by the following vote:
AYES: Councilmen:Crosby-Diederichsen-Johnson.
NOES: Councilmen: George -Martin.
