RESOLUTION NO. 25-66
A RESOLUTION AUTHCEMING SETTLEMENT OF PARCEL 2
RESOLVED, bythe City Council of the CITY OF BURLINGAME,
a Municipal Corporation, County of San Mateo, California, that
John E. Lynch of the law firm of Wilson, Jones, Morton & Lynch,
who, along with the City Attorney of the City of Burlingame, are
attorneys of record for the City of Burlingame in that certain
action entitled, "City of Burlingame v. Nielsen, et al.", in
the Superior Court of the Stateof California, in end for the
County of San Mateo, Action No. 119300, be, and he is, hereby
authorized and directed to accept, in behalf of said City, the
Offer to Sell, a. conformed copy of which is attached hereto, and
by this reference incorporated herein, heretofore submitted by
the owner of Parcel 2, as more particularly described in said
Offer, and in said complaint, and to close said transaction in
accordance with the terms and procedure set forth in add offer.
IT IS FURTHER RESOLVED, that the City Clerk is author
and hereby directed to draw his warrant forthwith in the sum of
$23,500.00, payable to the NORTH BURLINGAME WOMAN'S CLUB, INC.,
a corporation, and deliver said warrant to said John E. Lynch,
630 North San Mateo Drive, San Mateo, California, for transmitt
to aid owner.
PASSED AND ADOPTED by the following vote, this 4th day
of April 31966.

For and in consideration of the sum of One Dollar ($1.00

receipt of which is hereby acknowledged, the undersigned offers

to sell to the CITY OF BURLINGAME, a Municipal Corporation, that

certain parcel of land situate in the City of Burlingame, County
20
of San Mateo, State of California, designated as Parcel 2, and

more particu larly described in the above entitled proceeding.

The purchase price shall be the sum of TWENTY-EIGHT
23
THOUSAND, FIVE HUNDRED DOLLARS ($28,500.00), and exclusive
24
possession is to be delivered two months from close of escrow.

Seller is to retain right to remain in possession of sa.i,
26
parcel of land, not to exceed two months from close of escrow,
27
rent free.

Title to said parcel shall be delivered free and clear o:

all liens and encumbrances of every nature with the exception of
30
easements for public utility purposes. The purchase price shall
31
be dblivered into escrow, with appropriate escrow instructions

consistent with the terms of this offer, within 20 days after

acceptance of this offer. This offer shall be irrevocable for a
period of 45 days. City shall bear cost of escrow, if any, and
policy of title insurance. Real property taxes shall be prorated
as of the date of closure of escrow.
