HomeMy WebLinkAboutReso - CC - 017-1967that: RESOLUTION NO. 17 -67 ORDERING THE VACATION AND ABANDONMENT OF A PORTION OF A CERTAIN PUBLIC UTILITIES EASEMENT CONVEYED TO THE CITY OF BURLINGAME AND RECORDED APRIL 7, 1954, IN BOOK 2563 OF OFFICIAL RECORDS OF SAN MATEO COUNTY, CALIFORNIA, AT PAGES 568-570. RESOLVED, by the City Council of Burlingame, California, WHEREAS, said City Council did on the 20th day of February, 1967, adopt its certain Resolution No. 10 -67, en- titled, "Resolution Declaring Intention to Vacate and Abandon a Portion of Public Utilities Easement Conveyed to the City of Burlingame and Recorded April 7, 1954, in Book 2563 of Official Records of San Mateo County, California, at Pages 568-57011, de- claring its intention to vacate, abandon and close that certain public utility easement in said City of Burlingame, State of California, particularly described as follows: A portion of that easement described as PARCEL A in Deed of Dedication of Public Utility Easement granted by deed dated March 25, 1954 and recorded in Vol. 2563 0. R. pages 568-570 San Mateo County Records April 7, 1954 more particularly des- cribed as follows: A strip of land 10 feet wide located 5 feet on each side of the following described centerline; beginning at a point on the centerline of afore- mentioned PARCEL A, said point of beginning being N5202114011E 5.05 feet, N45°48'50'W 85.87 feet and N520211401E 95.00 feet from the most westerly corner of lot 21 block 5 as said lot and block are shown on that certain map entitled 1PBURLINGAME MANOR, BURLINGAME, CALIFORNIA". which map was filed in the office of the Recorder of San Mateo County September 12, 1946 in Book 26 of Maps at pages 15 and 16: thence N74°321101"E 59.10 feet to a point in the Northeasterly line of lot A as shown on aforesaid map of Burlingame Manor. WHEREAS, said Resolution No. 10-67, recites that said proceedings were being taken under and pursuant to the Public Service Easements Vacation Law of the State of California, and expressed its election to proceed under said law; -1- WHEREAS, said Resolution No. 10 -67 was duly adopted, published and posted in the time, manner and form provided by law; all as appears in Affidavits of Publication and of Posting on file in the office of the City Clerk of said city; WHEREAS, Notices of Easement Vacation were conspicu- ously posted in the manner required by law, along the lines of the portion of public utility easement proposed to be vacated, which said notices stated the time and place of hearing, and the adoption of the said Resolution No. 10 -67; WHEREAS, Monday, the 20th day of March, 1967, at the hour of 8 o'cbck P.M., at the Council Chambers of the City Council in the City Hall, in the City of Burlingame, was fixed in said Resolution No. 10 -67 as the time and place when and where any and all persons interested should appear and offer evidence in connection with said vacation of said portion of said ease - went; WHEREAS, after hearing the evidence, the City Council finds that said public utility easement hereinabove described is unnecessary for present or prospective public use; NOW, THEREFORE, IT IS HEREBY ORDERED that said portion of said public utility easement as hereinabove described, be, and it is hereby vacated and abandoned. MARR, of the City of Burlingame, California, being duly sworn, deposes and says: That at all times mentioned in this Affidavit he was and now is the duly appointed, qualified and acting City Engineer of the City of Burlingame; Ad That on the day of arral? 1967, he taus to be posted the attached 1°Notice of Easement Vacation"along the lines of the hereinafter particularly described easement; That said notices were posted not more than 300 feet apart and at least 3 notices were posted along the line of said easement, which said easement is situated in the City of Burlin County of San Mateo, State of California, and is described as follows: A portion of that easement described as PARCEL A in Deed of Dedication of Public Utility Easement granted by deed dated March 25, 1954 and re- corded in Vol. 2563 0. R. pages 568-570 San Mateo County Records April 7, 1954 more particularly described as follows: A strip of land 10 feet wide located 5 feet on each side of the following described centerline; beginning at a point on the centerline of afore- mentioned PARCEL A, said point of beginning being N52°2114011E 5.05 feet, N45048150'16q 85.87 feet and N5202114011E 95.00 feet from the most westerly corner of lot 21 block 5 as said lot and block are shown on that certain map entitled 1PBurlingame Manor, Burlingame, California", which map was filed in the office of the Recorder of San Mateo County September 12, 1946 in Book 26 of Maps at pages 15 and 16; thence N74032110"E 59.10 feet to a point in the Northeasterly line of lot A as shown on aforesaid map of Burlingame Manor.
