AUTHORIZATION FOR THE ATTORNEY GENERAL OF THE STATE OF
CALIFORNIA TO CONDUCT LEGAL PROCEEDINGS ON BEHALF OF
POLITICAL SUBDIVISIONS AND PUBLIC AGENCIES.
WHEREAS, the City of Burlingame, a Municipal Corporation,
acquired and expended monies for metal library shelving during the
period of an alleged combination and conspiracy in restraint of
interstate commerce in the manufacture and sale of such shelving;
and
WHEREAS, it appears that in the acquisition of said shelving
the City of Burlingame may have acquired the shelving, directly or
indirectly, from manufacturers acting pursuant to and in furtheranc
of an alleged combination and conspiracy in restraint of interstate
commerce or otherwise in violation of the antitrust laws of the
United States, with resulting financial injury and loss to the City
of Burlingame; and
WHEREAS, the Attorney General of California, acting in his
official capacity to protect and further the legal interests of the!
State, its political subdivisions and public agencies, and acting
pursuant to the provisions of Business and Professions Code section!
16 750 (c), has offered to act as the legal representative of the
City of Burlingame in connection with these matters, at no expense
to the City of Burlingame;
NOW THEREFORE, BE IT RESOLVED by the City Council of the City'
of Burlingame, that the Attorney General of the State of California
is hereby authorized to take such action as under the circumstances
he may deem appropriate to prepare, file, serve, and prosecute, and
to settle, compromise, dismiss in whole or in part or otherwise act
in connection with said action while acting for and on behalf of
said City of Burlingame in the matter of a treble damage antitrust
suit against certain suppliers of metal library shelving; and
BE IT FURTHER RESOLVED, that the Attorney General is further
authorized to allocate and distribute in such manner, at such
times, and in such amounts as may appear to him to be equitable
any monies or other things of value received as a result of said
action, whether secured by settlement, suit or otherwise, exceptir
the amount of attorneys' fees and costs determined or approved by
the Court, or mutually agreed upon by the plaintiffs in the actior
to be paid into the State Treasury;
BE IT FURTHER RESOLVED, that the duly constituted legal
advisor and attorney and all officials and employees of the City
of Burlingame be requested to render every possible assistance to
the Attorney General of California, in any action he may take.

a regular meeting of the City Council held on the 7th day of
February, 1966, and adopted thereafter by the following vote:
