APPOINTING CITY MANAGER AS EMPLOYEE RELATIONS
OFFICER
WHEREAS the MEYERS-MILIAS-BROWN ACT (GOVERNMENT CODE,
§§ 3500-3511, inclusive) became operative on January 1, 1969, and
WHEREAS, on April 20, 1970, the City Council of the City
of Burlingame adopted its Resolution No. 33-70 entitled "A Resolu-
tion of the City Council of the City of Burlingame Providing for
E,;ployer - Employee Relations" in implementation of said Act; and
WHEREAS, Section 12 of said Resolution provides that the
City Council shall designate a Municipal Employee Relations Offi-
cer who shall be the City's principal representative in all matters
of employer -employee relations, with authority to meet and confer
as required by said Act in good faith on matters within the scope
of representation including wages, hours and other conditions of
employment; and
WHEREAS, the City Manager of the City of Burlingame has
been the de Facto Municipal Employee Relations Officer ever since
the adoption of said Resolution No. 33-70, and ever since has met
and conferred with employees of the City and has recognized certain
employee organizations in the meet and confer process, as required
by said Act and by said Resolution No. 33-70;
NOW, THEREFORE, IT IS HEREBY RESOLVED:
1. The City Manager of the City of Burlingame be, and he
is hereby, appointed the Municipal Employee Relations Officer pro-
vided for in Section 12 of said Resolution No. 33-70, with all of
the rights, powers, duties and authorities set forth in said Re-
solution No. 33-70, and the Supplemental Rules and Regulations adopt-
ed concurrently with said Resolution No, 33-70.
2. All acts of the City Manager as de Facto Municipal
Employee Relations Officer done or performed by him since April
- 1 -
20, 1970, in meeting and conferring with employees of the City and
with recognized employee organizations, be and they are hereby, rati-
fied and confirmed.
I, HERBERT K. WHITE, City Clerk of the City of Burlingame,
do hereby certify that the foregoing resolution was introduced at a
regular meeting of the City Council held on the 1st day of June, 1970,
and adopted thereafter by the following vote:
AYES: Councilmen: Amstrup, Johnson, Mangini, Martin.
NOES: Councilmen: None.
Absent Councilmen: Crosby.
