HomeMy WebLinkAboutReso - CC - 087-1972RESOLUTION NO. 87 -72 A RESOLUTION DETERMINING THAT PUBLIC INTEREST AND NECESSITY REQUIRE THE ACQUISITION AND TAKING OF CERTAIN LAND AND DIRECTING THE FILING OF EMINENT DOMAIN PROCEEDINGS RESOLVED, by the City Council of the City of Burlingame, California, that WHEREAS, the lands hereinafter particularly described are adjacent and contiguous to lands presently owned in fee simple by the City of Burlingame for public park purposes; and WHEREAS, this Council desires to increase the area and size of said public park by the acquisition and addition of the lands hereinafter particularly described for public park purposes follows: NOW, THEREFORE, IT IS FOUND, DETERMINED AND ORDERED, as 1. That the public interest and necessity require the acquisition and taking by right of eminent domain the real pro- perty described in Exhibit A attached hereto, incorporated herein and made a part of this resolution by reference, and the fee simple thereof, and every interest therein for the use of said City as a public park. 2. That the proposed acquisition and taking is planned and located in the manner which will be most compatible with the greatest public good and the least private injury. 3. That Burress Karmel, City Attorney of the City of Burlingame, be, and he is, hereby directed to institute and con- duct to conclusion an action in eminent domain for the acquisi- tion of said lands and the taking of such action as is necessary - 1 - therein. Jose and Lydian H. Jose by Deed dated November 27, 1944 and filed in Book 1155 at page 128 of Official Records, San Mateo County, California; thence from said point of beginning along the northwesterly line of said Jose tract north 630 28' east, 380.71 feet and south 56° 56' east, 23.22 feet to westerly line of Adeline Drive as shown on that certain map entitled "BURLINGAME HILLS NO. 2, SAN MATEO COUNTY, CALIFORNIA" which was filed for record on August 23, 1926 in Book 14 of maps, at pages 18 and 19, San Mateo County Records; thence southerly on the westerly side of Adeline Drive on the arc of a curve to left whose radius is 225 feet and whose central angle is 421 51' an arc distance of 142.45 feet; thence leaving said westerly line of Adeline Drive south 631 28' west, 299.71 feet to the southwesterly line of the afore- mentioned Jose parcel; thence north 260 32' west 125.00 feet to the point of beginning; said parcel being parcel four as shown on that certain Record of Survey Map filed in Book 2 of Licensed Land Surveyors Maps at page 68, records of San Mateo County, California. (APN 27-030-030 & 050) Beginning at a point in the northwesterly line of Adeline Drive, which bears north 431 41' 04" west 50.42 feet from the most northerly corner of Lot 40 in Block 4, as designated on the Map entitled "BURLINGAME HILLS NO. 2, COUNTY OF SAN MATEO, STATE OF CALIFORNIA". which Map was filed in the Office of the Recorder of the County of San Mateo, State of California, on August 23, 1926 in Book 14 of Maps at pages 18 and 19 said point also being the most southerly corner of the lands described in the Deed from California Constructors, Inc., to George K. Wahlgren and wife, dated September 1, 1948 and recorded October 15, 1948 in Book 1581 of Official Records of San Mateo County at pages - 1 - 433 (56995-H) thence along the southwesterly line of the last mentioned lands north 47' 04' 20" west 423.31 feet the center of Mills Creek: thence southwesterly along the cen- ter line of Mills Creek to the most northerly corner of the lands described in the Deed from California Constructors, Inc., to William F. Nameny and wife, dated May 13, 1948 and recorded June 2, 1948 in Book 1521 of Official Records of San Mateo County at page 60 (34060-H); thence along the northeasterly line of the last mentioned lands south 370 40' 55" east 337.78 feet to the most westerly corner of that certain 1.7925 acre parcel described in the Deed from Panama Realty Co. a Corporation, to Richard F. Jose and wife, dated November 27, 1944 and re- corded December 2, 1944 in Book 1155 of Official Records of San Mateo County at page 128 (33194-F); thence along the northwesterly and northeasterly lines of the last mentioned lands north 630 28' east 380.71 feet and south 561 56' east 23.22 feet to the northwesterly line of Adeline Drive herein before mentioned: thence along the northwesterly line of Adeline Drive north 330 04' east 33.55 feet and along a curve to the right tangent to the last mentioned course said curve having a radius of 175 feet, an arc dis- tance of 60 feet more or less, to the point of beginning.
