HomeMy WebLinkAboutReso - CC - 007-1971RESOLUTION NO. 7-71 OF THE COUNCIL OF THE CITY OF BURLINGAME TO QUALIFY BURLINGAME FOR FEDERAL FLOOD AND MUDSLIDE INSURANCE WHEREAS, the Burlingame City Council believes that flood and mudslide insurance would be greatly beneficial to residents within our city; and WHEREAS, relief is available in the form of flood insurance as authorized by the National Flood Insurance Act of 1968 as amended; and WHEREAS, it is the intent of this Council to comply with land use and management criteria regulations as required in said act; and WHEREAS, it is also the intent of this Council to recognize and duly evaluate flood hazards in all official actions relating to Land use in the flood plain areas having special flood hazards; and WHEREAS, the Code Citations of any State enabling legisla- tion and any resulting county or city ordinance ordinance that authorizes this city to adopt land use and control measures are attached hereto as Exhibit A; NOW, THEREFORE, BE IT RESOLVED, that this Council hereby assures the Federal Insurance Administration that it will take legislative action as follows: 1. Enact by December 31, 1971, and maintain in force for those areas, adequate Land use and control measures with effective enforcement provisions consistent with the criteria set forth in Subpart A of Section 1910 of the National Flood Insurance Regulations; and 2. If necessary, seek State enabling legislation conferri authority to enact land use and control measures designed to reduce the exposure of property to flood loss; and 3. Take such other official action as may be reasonably necessary to carry out the objectives of the program. Such actions will include but not be limited to: a. Assisting the Federal Insurance Administrator, at his request, in delineating the limits of the flood plain having special flood hazard on available local maps of sufficient scale to identify the Location of the building sites. b. After flood insurance is made available, furnish- ing representatives of the National Flood Insurers Association (also appropriate Federal or State agen- cies, upon request) information concerning new or substantially improved structures within the area of special flood hazard. This information will include flood elevations and, if there is a basement, the distance between the first floor and the bottom of the lowest opening where water flowing on the ground will enter. C. Cooperating with Federal, State and local agencies which undertake to study, survey, map and identify flood -prone areas as well as cooperating with neigh- boring jurisdictions with respect to adjoining flood plains in order to prevent aggravation of the flooding problem. d. Providing the name of the individual and the office that will be responsible for furnishing the first floor elevation information. BE IT FURTHER RESOLVED, that this Council hereby appoints with the responsibility, authority and means to implement the commitment made herein the City Engineer, George Marr. Mayor I, Herebert K. White, City Clerk of the City of Burlingame, do hereby certify that the foregoing resolution was introduced at the regular meeting of the City Council held on the 16th day of Pebruary 1971, and adopted thereafter by the following vote: AYES: Councilmen 4mstrup, Crosby, Johnson, Mangini,Nlart NOES: Councilmen None Absent Councilmen None City Clerk EXHIBIT A Citation of Legal Authority of Burlingame,. (4) State Housing Law, California Health and Safety Code, Sections 17,910 et seq., with particular reference to Section 17,922 et seq., entitled: "Adoption of Rules and Regulations, Provisions imposing require- ments contained in Uniform Code, geographic, typo- graphic, and climatic conditions requirements reserved to Local conditions."
