HomeMy WebLinkAboutReso - CC - 076-1972WJML:KJmh 9-6-72-15 RESOLUTION NO. 76 -72 A RESOLUTION OF INTENTION TO ORDER THE VACATION OF A PUBLIC SERVICE EASEMENT BAYSIDE IMPROVEMENT DISTRICT,NO. 4 RESOLVED, by the City Council of the City of Burlingame, California, that ,his Council does hereby FIND, ORDER and DETERMINE that 1. This resolution is adopted pursuant to the Public Service Easements Vacation Law, Section 50430 and following of the Government Code. 2. The public interest and convenience require, and it is the intention of the Council to vacate a non-exclusive access easement acquired for public use as a pathway by Easement Deed from Anza Pacific Corp., dated February 19, 1970, and recorded as to said easement in the office of.the County Recorder of the County of San Mateo, California, on June 9, 1970 at Book 5791, page 502 (Series No. 23109AD Official Records). Said easement is more particularly described as follows: All that real property situate in the State of California, County of San Mateo, City of Burlingame, and being a portion of Section 18, Township 4 South, Range 4 West, Mount Diablo Base & Meridian, described as follows: A strip of land, 25 feet in width, the centerline of said strip described as follows: Commencing at the point of intersection of the north line of said Section 18 with the east line of Lot 1, Block 1 as said lot and block are shown on that certain map entitled "Anna Airport Park Unit No. 4" recorded July 26, 1968 in Volume 68 of Maps at Pages 10 & 11, Records of San Mateo County, California; thence from said point of commencement along the north line of said Section 18 North 890 43101" East 1421.44 feet to the point of beginning; thence from said point of beginning South 279.80 feet to the southerly terminous of the centerline of the herein described strip of land. The side lines of said strip to be lengthened or shortened so as to be bounded on the North by said North line of Section 18 and on the South by a line bearing North 89° 43' 01" East through said Southerly terminous of the centerline of the herein described strip of land. o N 3. Reference for further particulars is made to a plat on file in the office of the City Clerk labeled "Plat Showing Access Easement Proposed to be Vacated, Anza Pacific Pathway Easement", dated September 1, 1972, which plat refers to the easement pro- posed to be vacated pursuant to this resolution. 4. Notice is hereby given that Monday, the _�_th_ day of December , 1972, at the hour of 8:00 o'cloc' M. of said day, in the regular meeting place of said Council, ,ouncil Chambers, City Hall, Burlingame, California, are hereby fixed as the time and place when and where all persons interested in, or having objections to the proposed vacation of said easement, may appear before said Council and be heard. 5. The City Clerk shall publish notice of the time and place fixed for said hearing and of the adoption of this resolu- tion in the Burlingame Advance -Star, a newspaper of general cir- culation published in the City, once a week for at -least two successive weeks prior to said hearing. 6. Notices of the vacation of said easement shall be posted conspicuously along the line of said easement at least ten (10) days before the date set for hearing. Such notices shall be posted not more than 300 feet apart, but at least three (3) shall be posted. Such notices shall state the time and place of said hearing and the adoption of this Resolution of Intention.
