AUTHORIZING DESTRUCTION OF
CERTAIN RECORDS, DOCUMENTS AND PAPERS
WHEREAS, §34090 of the Government Code of the State of
California provides that with the approval of the legislative
body by resolution, and with the consent of the City Attorney, th
head of a city department may destroy any city record, document,
instrument, book or paper not less than five (5) years old, under
his charge, without making a copy thereof, after the same is no
longer required, with certain exceptions not here of concern;
and
WHEREAS, the Chief of Police has certified to this
Council by a memorandum in writing bearing the approval of the
City Manager that the Arrest Reports and Fingerprint Records more
particularly described in Exhibit A attached hereto, incorporated
herein and made a part of this resolution by reference are no
longer required and has recommended their destruction; and
WHEREAS, none of the documents particularly described
in Exhibit A attached are less than five (5) years old;
NOW, THEREFORE, the City Council of the City of
Burlingame does hereby resolve and determine as follows:
1. None of the records, documents or papers particu-
larly described in Exhibit A attached is less than five (5) years
old, nor is it longer required, and they, and each of them, may
be destroyed without loss or inconvenience to the City, its
officers, employees or agents, or to the public.
2. The written certification by the Chief of Police

as approved by the City Manager that the records, documents or
papers particularly described in Exhibit A attached are no longer
required shall be attached to this resolution, which shall not
become operative until the City Attorney, by his endorsement in
writing hereon, has consented to the destruction of said records,
documents and papers, as required by Government Code, §34090.

I, HERBERT K. WHITE, City Clerk, do hereby certify
that the foregoing resolution was introduced at a regular meeting
of the City Council held on the 21st day of August , 1972,
and adopted thereafter by the following vote:

ABSENT: COUNCILMEN Crosby

I consent to the destruction of the records, documents
and papers particularly described in Exhibit A attached to the
foregoing resolution, as records, documents and papers not other-
wise required by law to be kept and as no longer required.

inclusive.
*b. Arrests for intoxication, driving while
under the influence of alcohol, arrests
or holds for investigation, and lodger
reports, only.
*c. Subjects are now deceased or no longer
deemed potentially criminal by reason
of advanced age.
*d. Information contained is valueless.
*e. Approximate number is 500.
