RESOLUTION NO. 60-73
A RESOLUTION OF INTENTION TO MAKE
CHANGES AND MODIFICATIONS
BURLINGAME AVENUE AREA OFFSTREET PARKING DISTRICT
ASSESSMENT CREDIT FORMULA
RESOLVED, by the City Council of the City of Burlingame,
California, that the public interest, convenience and necessity
require, and that it is the intention of said Council to make
changes and modifications in the proceedings conducted pursuant
to Resolution of Intention No. 79-69 adopted by this Council on
October 6, 1969, and pursuant to Resolution of Intention No. 27-62,
adopted May 19, 1962, to provide for relief from the consequences
of having applied for and received credit against assessments
levied in said proceedings, based on the providing of private
offstreet parking facilities, by adding the following provisions
to said proceedings:
Any owner of lands who applied for and was granted relief
from assessments levied in said proceedings on the basis of having
provided private offstreet parking spaces, and ingress and egress
thereto (herein referred to as "the relief area"), and who wishes
to devote all or some portion of the relief area to some other use
in the same manner as if such assessment relief had not been granted,
may apply to the City for release of all or any designated portion
of the relief area (herein called "the area sought to be released"),
from the restrictions on its use imposed on account of the assess-
ment relief. The minimum size of the area sought to be released
pursuant to any one application shall be five spaces, unless the
owner owns less than five spaces, in which event the minimum area
sought to be released shall consist of all of such spaces.
The application shall show in diagram form the boundaries
and dimensions of the entire property, the improvement area and its
nature, the relief area, and the area sought to be released.
Upon receipt of the application, the City Engineer shall
compute the amount of the original additional assessment in both
proceedings Which would have been levied if the relief applied for
and granted with respect to the area sought to be released had not
been granted. These additional amounts shall then be increased
first by adding the amounts of interest which would have been paid
on the additional assessment amounts from the assessment bond issue
dates to the January 2 or July 2 next succeeding the date of the
application, computed at the various bond rates; and then by
increasing the resulting total by the annual percentage increases
in building construction costs as determined by the Engineering News
Record Indices for the years intervening since the levy of the
original assessment, or the percentage increase in the assessed
value of the land from the year of original levy to the year of the
application, whichever is greater.
The amount of $250 to cover administrative costs of the City
in making the above computations and reviewing the application
shall be added to the above total.
Upon payment of the accumulated total amount computed as
above provided in cash to the City, the area sought to be released
shall be relieved of the restrictions imposed on its use as the
result of the assessment relief theretofore applied for and granted;
provided, that nothing in this resolution nor in proceedings pro-
posed hereunder shall be construed to relieve the applicant nor his
property from any other requirements of law relating to the use or
improvement of said property.
All payments received by the City pursuant to this resolution
shall be received and held in trust by the City for the use and
benefit of the Burlingame Avenue Area Offstreet Parking District.

NOTICE IS HEREBY GIVEN that Tuesday, the bth day of September,
1973, at the hour of 8:00 o'clock P.M. in the regular meeting place
of said Council, Council Chambers, City Hall, Burlingame, California,
are hereby fixed as the time and place when and where said Council
will consider the matter of making said changes and modifications
and hearing all protests and persons interested therein.
The City Clerk of said City shall cause a copy of this
resolution to be published once in The Boutique -Villager, a news-
paper of general circulation published in said City, the paper in
which the Notice of Improvement under each of said Resolutions of
Intention having discontinued publication, and to be mailed to all
property owners whose property was granted assessment relief, said
publication and mailing to be at least ten days before said day of
hearing.

correct copy of a resolution duly passed and adopted by the City
Council of the City of Burlingame, California, at a meeting
thereof held on the 6th day of August, 1973, by the following vote:
