HomeMy WebLinkAboutReso - CC - 059-1973RESOLUTION NO. 59-73 RESOLUTION DECLARING INTENTION TO VACATE AND ABANDON PART OF PUBLIC UTILITIES EASEMENT ACROSS LOTS 1, 2, 3, 4 AND 8, VIEWLAND ESTATES, BURLINGAME, CALIFORNIA RESOLVED by the City Council of the City of Burlingame: 1. That the public interest and convenience require and that it is the intention of said Council to vacate, abandon and close a part of a certain public utility easement, which part is situated in the City of Burlingame, County of San Mateo, State of California, and is particularly described in Exhibit "A" at- tached hereto, incorporated herein and made a part of this Resolution by reference. 2. For a particular description of the part to be va- cated hereunder, reference is hereby made to that certain sub- division map on file in the office of the City Clerk of the City of Burlingame, entitled, "VIEWLAND ESTATES Burlingame, California" wherein that part of said public utility easement proposed to be vacated is colored in green. 3. That the City Council hereby elects to proceed under the Public Service Easements Vacation Law, 9§50430 through 50445 of the Government Code of the State of California. 4. Notice is hereby given that Monday , the 17th day of September, 1973, at 8 o'clock P. M., at the Council Chambers of the City Council in the City Hall, in the City of Burlingame, is hereby fixed as the time and place for - 1 - hearing of persons interested in the proposed vacation of said part of said easement. 5. The Clerk of said City shall cause this Resolution to be published once in the Hillsborough Boutique, a newspaper of general circulation published and circulated in said City, which said newspaper is hereby designated for that purpose. 6. The City Engineer of said City shall cause to be posted conspicuously along the line of said part of said easement proposed to be vacated, Notices of Easement Vacation. The notices shall be posted not more than 300 feet apart and at least three (3) such notices stating the time and place of hearing and the passage of this Resolution shall be posted. WHITE, City Clerk of the City of Burlingame, do hereby certify that the foregoing Resolution was introduced at a regular meeting of the City Council held on the 6th day of August , 1973, and adopted thereafter by the following vote: AYES: COUNCILMEN: Amstrup, Cusick, Mangini, Martin NOES: COUNCILMEN: None ABSENT: COUNCILMEN: Crosby - 2 -
