HomeMy WebLinkAboutReso - CC - 043-1973RESOLUTION NO. 43 -73 A RESOLUTION OF APPLICATION BY CITY OF BURLINGAME REQUESTING THE LOCAL AGENCY FORMATION COMMISSION TO TAKE PRELIMINARY PROCEEDINGS FOR DETACHMENT OF TERRITORY FROM THE SAN MATEO COUNTY HARBOR DISTRICT RESOLVED, by the City Council of the City of Burlingame, California, that WHEREAS, the City Council of the City of Burlingame desires to initiate preliminary proceedings pursuant to the District Reorganization Act of 1965, Title 6, Division 1 of the Government Code of the State of California, comprising Sections 56000 through 56550 of said Code, for the detachment of the ter- ritories within the corporate limits of the City of Burlingame from the San Mateo County Harbor District, (hereinafter sometimes referred to as the "City Territory"); and WHEREAS, the proposed detachment of City Territory will affect the County of San Mateo and the incorporated cities in the County of San Mateo; and WHEREAS, the City Territory proposed to be detached is inhabited, as such term is defined in Section 56045 of the Government Code, a part of the District Reorganization Act of 1965, and a description of the exterior boundaries of the City Territory is set forth in Exhibit "A" hereto attached and by reference incorporated herein; and WHEREAS, it is desired to provide that the proposed - 1 - detachment be subject to certain terms and conditions as provided in Sections 56490 through 56492 of the Government Code; NOW, THEREFORE, IT IS HEREBY FOUND, DETERMINED AND ORDERED, as follows: 1. That this Resolution of Application be, and it is hereby, adopted and approved by the City Council of the City of Burlingame, and the Local Agency Formation Commission of San Mateo County be, and it is hereby, requested to undertake pre- liminary proceedings for the detachment of City Territory described in Exhibit "A" hereto attached and by reference incor- porated herein from the San Mateo County Harbor District, on the terms and conditions herein stated and in the manner provided by the District Reorganization Act of 1965. 2. That the City Territory proposed to be detached from the San Mateo County Harbor District is inhabited. The exterior boundaries of the City Territory proposed to be detached are more particularly described in said Exhibit "A" 3. That the reason for this proposed change of organi- zation is that the residents and taxpayers of the City of Burlingame are not benefited by and do not utilize the services and facilities provided by San Mateo County Harbor District, which District does not have facilities and improvements which can adequately and economically furnish services which are urgently needed by the City Territory or by its inhabitants. 4. That the Local Agency Formation Commission is here- by requested to approve the proposed detachment following notice and hearing by the Commission, and to transmit to the District its approval of the detachment of City Territory from the San - 2 - Mateo County Harbor District in accordance with the authorizations and requirements of said District Reorganization Act. 5. That the City Manager be, and he is hereby, author- ized and directed to execute all applications, petitions, instruments, documents and papers, on behalf of the City of Burlingame, which may be necessary or convenient to accomplish the proposed detachment and to effect the purpose of this Resolution, and the City Clerk be, and he is hereby, authorized and directed to attest to the signature of the City Manager in al such cases. 6. That the City Clerk be, and he is hereby, authori and directed to file a certified copy of this Resolution with the executive officer of the Local Agency Formation Commission of the County of San Mateo, State of California. iu�i�'Z73 I, HERBERT K.
