HomeMy WebLinkAboutReso - CC - 028-1972WJML:KJmh 5-9-72-20 RESOLUTION NO. 28 -72 A RESOLUTION DETERMINING THAT THERE IS NEED FOR A PARKING AUTHORITY IN THE CITY OF BURLINGAME UNDER AND PURSUANT TO THE PARKING LAW OF 1949 TO FUNCTION IN THE CITY AND DECLARING THE COUNCIL OF THE CITY OF BURLINGAME TO BE THE PARKING AUTHORITY RESOLVED, by the City Council of the City of Burlingame, California, that WHEREAS, pursuant to Section 32650 of the Streets and Highways Code of the State of California, there has been created and now exists a public body corporate and politic known as the Parking Authority of the City of Burlingame in accordance with the provi- sions of the Parking Law of 1949; and WHEREAS, the Parking Law of 1949 provides that the Parking Authority shall not transact any business or exercise any powers unless and until the Council by resolution declares that there is need for the Authority to function in the City of Burlingame; NOW, THEREFORE, IT IS ORDERED, as follows: 1. Need. The Council hereby declares that there is need for a parking authority to function in the City, and that there is a need for the City to exercise the power of a parking authority. 2. Name. The name of the parking authority shall be "City of Burlingame Parking Authority", hereinafter referred to as "the Authority" 3. Organization. The Council hereby declares itself to be the Authority and all of the rights, powers, duties, privileges and immunities vested by law in the Authority, except as otherwise provided in this Resolution, shall be vested in the Council as the Authority. The Mayor shall act as the chairman and presiding of- ficer of the Authority, and the City Clerk and City Treasurer, respectively, shall act as Clerk and Treasurer of the Authority. 4. Jurisdiction. The Authority may have jurisdiction and control over any parking project undertaken after the date of adoption of this resolution within the City limits of the City of Burlingame. 5. Effective Date.
