HomeMy WebLinkAboutReso - CC - 072-1974REST JTION NO. 72-74 RESOLUTION OF INTENTION TO APPROVE AN AMENDMENT TO CONTRACT BETWEEN THE BOARD OF ADMINISTRATION OF THE PUBLIC EMPLOYEES' RETIREMENT SYSTEM AND THE CITY COUNCIL OF THE CITY OF BURLINGAME WHEREAS, the Public Employees' Retirement Law permits the participation of public agencies and their employees in the Public Employees' Retirement System by the execution of a contract, and sets forth the procedure by which said public agencies may elect to subject themselves and their employees to amendments to said law; and WHEREAS, one of the steps in the procedure to amend this contract is the adoption by the legislative body of the public agency of a resolution giving notice of its intention to approve an amendment to said contract, which resolution shall contain a summary of the changes proposed in said con- tract; and WHEREAS, the following is a statement of the proposed change: Provides under AB 3093, Chapter 470, Statutes of 1974 that an agency redefine the definition of local policemen to permit all persons assigned to identification and communication duties in the police department who are not now local safety members and who were in such employment on August 4, 1972, to elect safety membership within sixty days of the effective date of the amendment; and WHEREAS, the cost of such change for the public agency with both miscellaneous and safety categories of membership can be estimated by applying the difference between the public agency's contribution rate for its safety members and its contribution rate for its miscellaneous members to the covered payroll of the members affected by this amendment; NOW, THEREFORE BE IT RESOLVED, THAT THE CITY COUNCIL OF THE CITY OF BURLINGAME, gives, and it does hereby give notice of intention to approve an amendment to the contract between the CITY COUNCIL and the Board of Administration of the Public Employees' Retirement System to accomplish the above change. The following subparagraph shall be added to Paragraph 7 of said contract: 7 (e) "Local Policemen" shall include persons assigned to identifica- tion and communication duties in the Police Department who are not now local safety members and who were in such employment on August 4, 1972, who elect safety membership within sixty days of the effective date of this amendment.
