HomeMy WebLinkAboutReso - CC - 020-1972RESOLUTION NO. 20-72 AUTHORIZING AND DIRECTING ISSUANCE OF REVOCABLE PERMIT TO PACIFIC TELEPHONE AND TELEGRAPH COMPANY FOR INSTALLATION, MAINTENANCE AND OPERATION OF THREE PUBLIC PAY TELEPHONES ON BURLINGAME AVENUE, A PUBLIC STREET RESOLVED, by the City Council of the City of Burlingame, California, and this Council does hereby FIND, ORDER AND DETER- MINE as follows: 1. The public interest and convenience require issuance of the revocable permit cited in the above title. 2. The City Manager be, and he is hereby, authorized to sign and issue said permit for and on befalf of the City of Burlingame. 3. The City Clerk is hereby ordered and instructed to attest said signature. Mayog I, HEREBERT K. WHITE, City Clerk of the City of Burlingame do hereby certify that the foregoing resolution was introduced at a regular meeting of the City Council held on the 3rd day of April 1972, and adopted thereafter by the following vote: AYES: Councilmen: Amstrup, Crosby, Mangini, Martin NOES: Councilmen: None Absent: Councilmen: Johnson Herbert 'K White City Clerk CITY OF BURLINGAME REVOCABLE PERMIT Pursuant to resolution of the City Council of the City of Burlingame, a municipal corporation, permission is hereby granted to PACIFIC TELEPHONE AND TELEGRAPH COMPANY, a corporation (hereinafter called "Permittee"), to place and maintain three (3) public telephones on the sidewalk of Burlingame Avenue, a public street, in the City of Burlingame, County of San Mateo, State of California at such locations as may be designated or approved in writing by the City Manager._ This permit is issued subject to the following conditions: 1. Permittee shall maintain said public telephones and an associated booths in good repair and safe and sightly condition at Permittee's expense and to the satisfaction of City Manager. 2. Permittee shall save the City of Burlingame harmless from any and all losses, claims, demands or judgments for damages to any person or property arising from the installation of maintenance of said public telephones. 3. Permittee shall pay to the City of Burlingame an amount equal to fifteen per cent (15%),of the receipts in lawful money of the United States (exclusive of Federal communications excise taxes) from the coin receptacles of the public telephones installed pursuant to this per- mit. Payments shall be made to the City of Burlingame not less frequently than annually: 4. This permit shall be revocable on thirty (30) days prior written notice to Permittee from the City Manager, in which event Permittee shall at its own expense remove all public telephones installed pursuant to this permit and shall restore the didewalk as nearly as practicable to is condition prior to such installations. 5. This permit is a grant of permission only and shall not obligate Permittee to maintain a public telephone at an, particular location. Permittee may at any time remove any public telephone installed pursuant to this permit. Upon such removal, Permittee shall restore the sidew7 lk as provided in Condition 4 hereof.
