HomeMy WebLinkAboutReso - CC - 092-1972WJML:KJmh 11-22-72-20 I D NOV 3 0 11972 RESOLUTION NO. 9 z -72 CITY MGINFXR CITY OF BURLINGAME A RESOLUTION ORDERING THE TERMINATION OF A PORTION OF AN OFFER OF DEDICATION AND ABANDONMENT OF RIGHT TO ACCEPT SAID PORTION OF SAID OFFER BAYSIDE IMPROVEMENT DISTRICT NO. 4 RESOLVED, by the City Council of the City of Burlingame, California, that WHEREAS, said Council did, on November 6, 1972, adopt its Reso- lution of Intention to order the termination of a portion of an irrevocable offer of dedication (hereinafter referred to as the "Offer") and the abandonment of the right to accept said portion of the Offer, which Offer was made by Anza Pacific Corp. on February 26, 1969, consented to by the Council by Resolution No. 16-69 on March 3, 1969, and recorded in the office of the County Recorder of the County of San Mateo in Volume 5610, page 291, on March 12, 1969, and which portion of the Offer refers to real property com- monly known as a part of the "Proposed 'C' Road right-of-way" or "Anna Pacific Boulevard", and more particularly described in Exhibit "A" attached hereto and incorporated herein by reference; WHEREAS, said Resolution of Intention recited that it was adopted pursuant to Government Code Section 7050 and Part 3 (com- mencing with Section 8300) of Division 9 of the Streets and High- ways Code; WHEREAS, Monday, the 4th day of December, 1972, at the hour of 8:00 o'clock P.M., at the Council Chambers, City Hall, Burlingame, California, were fixed in said Resolution of Intention as the date, time and place when and where any and all persons interested in or objecting to the proposed termination of said portion of the Offer and abandonment of right to accept said portion of the Offer might appear before said Council and show cause why the Council should not order said termination and abandonment in accordance with said Resolution of Intention and the law in the premises; WHEREAS, said Resolution of Intention was duly published and notices entitled "Notice of Proposed Termination of Portion of Offer of Dedication" were duly posted in the time, manner and form provided by law, as appear from the affidavits of publication and posting on file in the office of the City Clerk; WHEREAS, said hearing was duly held on the date, at the time and in the place stated in said Resolution of Intention, and evi- dence was duly offered and considered by the Council, and the Council has acquired jurisdiction to order said termination and abandonment; NOW, THEREFORE, IT IS FOUND, DETERMINED and ORDERED, as follows: 1. That the portion of the real property offered for dedica- tion in the Offer and more particularly described in Exhibit "A" attached hereto and incorporated herein by reference is unnecessary for present or prospective public use for public street, road, utility or related purposes inasmuch as said portion of real prop- erty is entirely under the waters of San Francisco Bay. 2. That said portion of the Offer is hereby terminated and the right to accept said portion of the Offer is hereby abandoned. 3. That the City Clerk shall cause a certified copy of this Resolution to be recorded in the office of the County Recorder of the County of San Mateo pursuant to the provisions of Section 8324 of the Streets and Highways Code. K I hereby certify that the foregoing is a full, true and correct copy of a resolution duly passed and adopted by the City Council of the City of Burlingame, California, at a meeting thereof held on the day of G . 3 1972, by the following vote: AYES, and in favor thereof, Councilmen: NOES, Councilmen: ABSENT, Councilmen: City Clerk of the City of Burlingame APPROVE: Mayor EXHIBIT "A" Anza Pacific Boulevard (Portion outside Anza Airport Park Unit 6) All that real property situate in a portion of the northerly half of Section No. 18, T4S, Row, Mt. Diablo B & M within the City of Burlingame, County of San Mateo, State of California, described as follows: Beginning at the most northerly corner of Lot No. 1, Block No. 3, as said lot and block are shown on that certain Map entitled "Anna Airport Park Unit No. 5, Burlingame, San Mateo County, California", which Map was filed in Map Book Volume 68 at pages 12 and 13 on July 26, 1968, Official Records of San Mateo County, California- thence from said point of beginning north 380 00' 00A west 56.54 feet to the most easterly corner of Lot No. 3, Block No. 1 as said Lot No. 3 and Block No. 1 are shown on that certain Map entitled "Anza Airport Park Unit No. 4, Burlingame, San Mateo County California", which Map was filed in Map Book Volume 6� at pages 10 and 11, on July 26, 1968, Official Records of San Mateo County, California; thence along the arc of a curve to the right tangent to a line that bears north 590 31' 51" east having a radius of 628.00 feet and a central angle of 300 11' 10", an arc len th of 330.86 feet; thence north 890 43' 01" east 1589.64 feet; thence along the arc of a curve to the right with a radius of 628.00 feet, and a central angle of 250 16' 59", an arc length of 277.12 feet to a point in the exterior line of Anza Airport Park Unit No. 6, as shown on that certain map which was filed in Maps Book Volume 70 at pages 33, 34, and 35, on February 27, 1970, Official Records of San Mateo County, California; thence along said exterior line south 250 00' 00" west 56.00 feet; thence along the arc of a curve to the left tangent to a line that bears north 650 00' 00" west having a radius of 572.00 feet and a central angle of 25° 16' 59", an arc length of 252.E+1 feet; thence south 890 43' 01" west 1586.64 feet; thence along the arc of a curve to the left with a radius of 572.00 feet and a central angle of 290 26' 38", an arc length of 293.95 feet to the point of beginning. Contains 2.78 acres, more or less.
