AWARDING CONTRACT
WATER SYSTEM IMPROVEMENTS
JOB NO. 74-2
WHEREAS, the City Council has authorized an invitation
for bids for approximately 8,350 linear feet of water main con-
struction work and all appurtenant work, as specified; and
WHEREAS, on September 11, 1974, all bids received were
opened before the City Clerk and the Director of Public Works; and
WHEREAS, SHAW CONSTRUCTION CO., a corporation, submitted
the lowest bid for doing said work for the sum of $188,976.00; and
WHEREAS, upon opening the bids the following irregular-
ities in submitting the SHAW CONSTRUCTION CO. bid were ascertained
viz:
(1) The titles of the persons purporting to sign
the bid on behalf of the corporation do not appear upon
the bid, so that the authority of the persons who signed'i
the bid, or of either of them, to act upon behalf of the
corporation in making and submitting the bid does not
appear upon the face of the bid.
(2) The corporate seal was not affixed to, nor im-
pressed upon the bid.
(3) The bid was not accompanied by a bid bond as
required by the Invitation for Bids, nor was it accom-
panied by any of the forms of bidder's security, pro-
vided for in California Government Code, 5 37931.

5 37932 of the Government Code provides for security in
an amount equal to at least 10 per cent of the amount
bid and provides, further, that a bid shall not be con-
sidered unless one of the forms of bidder's security is
enclosed with it.
(4) That portion of the bid form requiring the
bidder to state and to list its experience qualifica-
tions was returned blank with no substitute statement of
experience qualifications, so that the bidder's experi-
ence qualifications, if any, cannot be ascertained from
the bid documents; and
WHEREAS, the City Council does not deem it to be in the
public interest, convenience or necessity, to waive the foregoing
bid irregularities, or any of them; and
WHEREAS, WENRICK & ASSOCIATES, a corporation, submitted
the next lowest bid for doing said work for the sum of $205,877.00
that:
NOW, THEREFORE, BE IT RESOLVED AND IT IS HEREBY ORDERED
1. The public interest, convenience and necessity do
not require that the irregularities in the bid submitted by the
lowest bidder, SHAW CONSTRUCTION CO., a corporation, be waived.
2. The bid of SHAW CONSTRUCTION CO., a corporation,
lowest bidder, in the amount of $188,976.00 be, and the same is
hereby, rejected by reason of the irregularities in the bid set
forth above.
3. The bid of WENRICK & ASSOCIATES, a corporation, for
the sum of $205,877.00, be, and the same is hereby, accepted.
BE IT FURTHER RESOLVED that a contract be entered into
between the successful bidder hereinabove referred to and the City

of Burlingame for the performance of said work and that the City
Manager be, and he is hereby, authorized for and on behalf of the
City of Burlingame, to execute said contract, and to approve the
faithful performance bond and labor and materials bond required
to be furnished by the contractor.

Burlingame, do hereby certify that the foregoing Resolution was
introduced at a regular meeting of the City Council held on the
16th day of September, 1974, and adopted thereafter by the
following vote:
