HomeMy WebLinkAboutReso - CC - 022-1973RESOLUTION NO. 22 -73 APPROVING AND RATIFYING LETTER AGREEMENT WITH FAIRLEY CONSTRUCTORS FOR REPLACEMENT OF 12-INCH WATER MAIN ON AN EMERGENCY BASIS WHEREAS, the City of Burlingame owns, maintains and operates the water distribution system within the City; and WHEREAS, on or about February 3 , 1973, a part of said water distribution system consisting of a 12-inch cast iron water line situated on the easterly side of Bayshore Freeway right-of-way opposite Mitten Road, a public street, rup- tured, necessitating a shut-off of said line; and WHEREAS, the water line of which said ruptured pipe is a part serves that part of the City commonly known as the East Millsdale Industrial Area with water for both fire protection and domestic uses; and WHEREAS, there was and is no feasible alternative to the shut-off of the flow of water within said water line for the purpose of replacement of the ruptured portion of said line; and WHEREAS, the shut-off of said water line has resulted in a reduced fire flow measured in gallons per minute of water to the Millsdale Industrial Area of approximately one-half of the fire flow which served the area prior to the rupture; and WHEREAS, the reduced fire flow constitutes a danger to the area and could result in an extraordinary fire by reason of insufficient water to quench any fire or fires which might occur within said area, which would be a great public calamity and disaster; and - 1 - WHEREAS, the public interest and necessity demand the immediate expenditure of public money to safeguard life, health and property within the area and perhaps other areas of the City, in order to effect emergency replacement of the ruptured water main and to repair the water distribution system; NOW, THEREFORE, IT IS HEREBY RESOLVED, ORDERED AND DETERMINED: 1. There was and is danger of an extra -ordinary fire which would constitute a great public calamity and disaster if emergency work were not done to replace the ruptured water main and to repair the water distribution system. 2. By reason of the present danger of such great public disaster and calamity, the public interest and necessity demand the immediate expenditure of public money to safeguard life, health and property. 3. An emergency exists which requires the expenditure of such monies without complying with the requirements of the Government Code, Title 4, Division 3, Part 2, Chapter 6, relating to notices inviting bids, submission of bids, award, and contract for public projects in an amount exceeding $3,500.00, procedures which would entail a minimum of six (6) weeks in time. 4. The letter agreement dated February 9, 1973, by and between the City of Burlingame and Fairley Constructors, a cor- poration, a copy of which is attached hereto, incorporated herein and made a part of this resolution by reference, for the perfor- mance of said work of replacement and repair, in accordance with its terms is hereby approved, and its execution on behalf of the - 2 - City of Burlingame by the City Manager and the Director of Public Works is hereby ratified and confirmed.
