RESOLVED, by the City Council of the City of
Burlingame, California, and this Council does hereby FIND, ORDER
IAND DETERMINE as follows:
1. The public interest and convenience require execu-
tion of the agreement cited in the title above.
2. The City Manager be and he is hereby authorized to
isign said agreement for and on behalf of the City of Burlingame.
3. The City Clerk is hereby ordered and instructed to
lattest such signature.

SECOND SUPPLEMENT TO AGREEMENT
FOR ENGINEERING SERVICES
BURLINGAME - MILLBRAE CENTRAL BAY OUTFALL SYSTEM
THIS SECOND SUPPLEMENT TO AGREEMENT is made and entered in duplicate

a municipal corporation, hereinafter referred to as "CITY",
t party, and JENKS & ADAMSON, a corporation, 543 Byron Street, Palo Alto,
�Znxnia, hereinafter called "ENGINEER", second party.
RECITALS
CITY, acting on behalf of itself and the City of Millbrae, as per terms
' a ::o=nt Venture Agreement, has contracted with ENGINEER for professional
:�tyvices in connection with preliminary reports, design and preparation of
Plans & Specification, field engineering, and related special services in
neca ion with the Cities' cooperative wastewater management program for
.ra;isport and disposal; said contracted services being in the form of a

;,AY 'OiTFALL SYSTEM, fully authorized, executed, and dated, July 3, 1972,

I.o.) ENGINEER has completed the Project Report in September 1972, and also
as completed Plans $ Specifications for a Joint Use Outfall Line project,
,�-xa CITY has advertised, received bids, and awarded a Construction Contract
fx this improvement project; Construction was commenced on April 22, 1974,
en- is nearing completion, and ENGINEER has been authorized to, and is now
actively engaged in, performing Field Engineering and Inspection services

(c+ The Division of Water Quality Control of the STATE OF CALIFORNIA, the
ccntral agency administering the Clean Water Grants program by which CITY'S
project is receiving Federal and State financial assistance, has suspended
any further Federal/State grant progress payments to CITY stating that CITY
must prepare a revised Revenue Program for wastewater management in
contormance with the September 1974 State Guidelines for such Revenue Programs.
(d) CITY, in compliance with State's directives, proposes to utilize
ENGINEER'S services to revise to 1974 Guideline standards the Revenue Program
contained in the 1972 Project Report for the Cities of Burlingame and
Millbrae and to include programs for contracting agencies.
AGREEMENT
1. CITY employs ENGINEER to provide and perform the services hereinbefore
set forth to effect the revision of the Revenue Programs as acceptable
to CITY and the State grant administering agency.
2. The Fee for the services under this Second Supplement to Agreement shall
be the lump sum amount of Two.Thousand Nine Hundred Dollars ($2,900.00),
payable upon completion of the acceptable Revenue Program and delivery
to CITY.
3. ENGINEER agrees to commence upon the work involved with this Second
Supplement to Agreement immediately upon receipt of authorization by
CITY, and agrees to diligently and continuously prosecute the work to
completion.
4. This Second Supplement is subject to the terms and conditions contained
in the original AGREEMENT and they are incorporated herein by reference
as if fully set forth herein.

IN WITNESS WHEREOF, two identical counterparts of this Second
Supplement to Agreement, each of which counterpart shall for all purposes
be deemed an original of said Supplement, have been duly executed by the
parties hereinabove named, on the day and year first hereinabove written.
