HomeMy WebLinkAboutReso - CC - 010-1973RESOLUTION NO. 10-7-1 MAKING ENVIRONMENTAL IMPACT REPORT DRIVE-IN MOVIE THEATER SCREENS 350 BEACH ROAD WHEREAS, the California Environmental Quality Act of 1970, as amended (Public Resources Code §§2100 to 21174, inclu- sive), expressly provides that it shall not prohibit or prevent a public agency from considering environmental factors in con- nection with the approval or disapproval of a project pending the preparation and development of proposed guidelines by the California Office of Planning and Research and the certification and adoption of such guidelines by the Secretary of the Resources Agency of the State of California; and WHEREAS, the California Environmental Quality Act of 1970 has been construed by the California Supreme Court to re- quire local governmental agencies, including cities, to make an environmental impact report upon all private applications for lease, permit, license, certificate, or other entitlement of use; and WHEREAS, members of the public and other concerned par- ties must be given an opportunity to provide input both in the making of the report and the ultimate decision upon the private application based in part upon that report; and WHEREAS, an Environmental Impact Report entitled and numbered as set forth above has been prepared and filed in the Office of the City Clerk of this City, and set for hearing - 1 - before this Council; and WHEREAS, a copy of said Environmental Impact Report was posted at the place, and a notice of hearing was published in the form and manner, and at the times heretofor provided by this Council; and WHEREAS, on the 5th day of February, , 1973 , at the hour of 8:00 o'clock P.M., in the Council Chambers in the City Hall of the City of Burlingame, County of San Mateo, State of California, said time and place being the day, hour and place fixed by the City Clerk for hearing upon said Environmental Impact Report, the City Council did hear and pass upon said Environmental Impact Report, at which hearing all persons desir- ing to be heard were heard and evidence, both oral and documen- tary, was received from all persons desiring to introduce evi- dence; NOW, THEREFORE, it is hereby ordered that: 1. The Environmental Impact Report designated above, as the same was prepared and filed with the City Clerk, be, and the same is hereby declared to be the Environmental Impact Report required by law to be made by the local agency, and is hereby made by this Council for and on behalf of the City of Burlingame, subject only to the following modifications: NONE - 2 - l U MAYOR I, HERBERT K.
