1124 BERNAL AVENUE, BURLINGAME
WHEREAS, on May 19, 1975, application was made to the Planning
Commission of the City of Burlingame, by ZINA G. BASKETT, owner of those
premises located at 1124 Bernal Avenue, Burlingame (Assessor's Parcel No.
026-182-170; Lot 21, Block 34, Easton Subdivision No.2); and
WHEREAS, said application requested a special permit for caretaker's
quarters in a separate residential unit already in existence upon said
property; and
WHEREAS, said special permit was denied by the Planning Commission
following a public hearing upon said application scheduled and held on the
23rd day of June, 1975, notice of said hearing having been given as required
by law; and
WHEREAS, the applicant filed a timely appeal from the denial of said
special permit, and a public hearing of the City Council upon said appeal was
scheduled and held on the 21st day of July, 1975;
NOW, THEREFORE, it is ordered and determined by the City Council of
Burlingame that:
1. The following findings of facts are made regarding said property:
(a) Said property is located in the R-1 zone of the City of
Burlingame and is therefore limited to one building designed or used
as a residence for one family.
(b) The separate residential unit to the rear of the original
house on said premises existed at the time of the application herein,
having been given a permit for use as a radio shop in 1947. Said
residential unit now contains a bathroom, living room, bedroom, pantry,
laundry, a stove and a refrigerator. Said premises had been occupied
by the son of the applicant, but are now occupied by a person unrelated

to her who receives the use of said premises in exchange for care-
taker's services.
2. The use of said residential unit to the rear of the main
house at the above described premises for residential purposes, with kitchen
facilities and by a person unrelated to the owner or occupant of the main
dwelling house, is and has been illegal and in violation of the ordinance code
of the City of Burlingame.
3.. The decision of the Planning Commission denying the special
permit as hereinabove set forth is affirmed.
4. The Clerk shall cause a copy of this resolution to be recorded
with the County Recorder of the County of San Mateo.
HERBERT K. WHITE, City Clerk of the City of Burlingame, does
hereby certify that the foregoing Resolution was introduced at a regular
meeting of the City Council held on the 4thday of August 1975,
and adopted thereafter by the following vote:
