HomeMy WebLinkAboutReso - CC - 022-1974RESOLUTION NO. 22 - 74 RESOLUTION OF THE BURLINGAME CITY COUNCIL REQUESTING THE METROPOLITAN TRANSPORTATION COMMISSION TO ASSIST WITH INVALIDATION OF THE PUBLIC UTILITIES COMMISSION'S ORDER TO RELOCATE SOUTHERN PACIFIC'S THIRD AND TOWNSEND STATION WHEREAS, the Public Utilities Commission of the State of California issued a permit order to the Southern Pacific Transportation Company allowing said company to relocate its Third and Townsend Station to the intersection of Fourth and Townsend; and WHEREAS, this order was made in recognition of a need to provide an on ramp to Interstate 280 from Fourth Street, an off ramp which would sever the existing trackage right of way between Third and Townsend Streets and the Financial District of San Francisco; and WHEREAS, the public was consistently refused the right of g of this order which allows the Southern Pacific Transportation to build a new depot without adequate rain shed protection; and WHEREAS, abandonment of Southern Pacific right of way pre-empts the Metropolitan Transportation Commission's decision -making alternative of upgrading and extending Southern Pacific commute service into downtown San Francisco; and WHEREAS, the Public Utilities Commission's order was rendered without the benefit of receiving an Environmental Impact Report as required by law, NOW, THEREFORE BE IT RESOLVED, that the City Council of the City of Burlingame hereby requests the Metropolitan Transportation Commission to intercede in courts of law in order to invalidate the Public Utilities Commission's order until such time as an Environmental Impact Report is submitted as required by law. n MAYOR I, HEREBERT K.
