HomeMy WebLinkAboutReso - CC - 005-1975RESOLUTION NO. 5-75 A RESOLUTION 0F.T11E CITY COUNCIL OF THE CITY OF BURLINGAME AUTHORIZING EXAySINATION OF SALES AND USE TAX RECORDS VMEREAS, pursuant to Ordinance 996 , the City of Burlingame entered into a contract with the State Board of Equalization to perform all functions incident to the administration and collections of local sales and use taxes; and -WHEREAS, the City Council of the City of Burlingame deems it desirable and necessary from time to time for a representative of the City to audit for and in its behalf the sales and use tax transactions and co llec- .tions that are made .for the City by the State Board of Equalization; and WHEREAS, Section 7056 of the Revenue and Taxation Code of the State of California states in part that the Board shall permit any duly authorized officer, or employee of such city, to examine all of the sales and use tax records of the City; . NOW, THEREFORE, THE -CITY COUNCIL OF TF.E CITY OF BURLINGAME VEREBY RESOLVES AS FOLLONS: SECTION 1. That the City Manager, or any designated assistant or employee of such ozrzcer, is herebv appointed to represent the City of �t,ri;Dgame with full authority to investigate and review sales and usc tax trar,�4c 1_oi?s and collections for the City, contained in the records of the State Board of Equalization. SECTION 2. That as provided in Section 7056 of the Revenue and Taxation Code, TO _nformation so gained by the City Manager or any designated assistant or employee of such officer shall be used only for purposes related to the col- lection of local sales and use taxes by the Board pursuant to the contract. Schwalm, City Manager FROM: Wayne M. Swan, City Planner During recent investigation of how use tax money is distributed, I learned that the State Board of Equalization has a new system for distributing printouts of their quarterly reports. Previous mailing to the City Clerk received no response from the City of Burlingame. I recommend this matter be reconsidered so that we can obtain valuable information for budgeting and economic analyses. With vehicle sales off 260, our sales tax revenue will be down. The trend of sales tax revenue from specialty restaurants will, hopefully, be up. Since the quarterly reports will be made available at no charge to the City, I think we should obtain this information. To obtain the local sales and use tax information, the Board of Equalization requires a resolution by the City Council authorizing the City Manager or his representative to examine sales and use tax records. Our Director of Finance is fully acquainted and experienced in these matters. We think a resolution should be taken to the Council by the Consent Calendar for early approval.
