White City Cl APPROVING EXECUTION OF UTILITY AGREEMENT, ORDERING THE VACATION AND ABANDONMENT OF AN EASEMENT, AND ACCEPTING NEW EASEMENT LANDS OF ANZA-PACIFIC RESOLVED, by the City Council of the City of Burlingame, California, that: WHEREAS, there has been presented to this Council an agreement between the ANZA-PACIFIC CORPOP.ATION and the CITY OF BURLINGAME providing for the granting of certain access rights to public utilities by Anza-Pacific; and WHEREAS, there has also been presented to this Council the proposal that that certain easement between Units 5 and 6 of Anza-Pacific be abandoned in exchange for an easement through an adjacent lot; and WHEREAS, the easement to be abandoned has not been used for the purpose for which it was dedicated for five years next preceding the date of this resolution and has not been used continuously or ever, or at all, since the date of its dedication, and it is unnecessary for present or prospective public use; NOW, THEREFORE, it is ORDERED AND DETERMINED as follows: 1. The City Manager is authorized to execute the utility agreement hereabove described agreement for and on behalf of the City of Burlingame. 2. The public interest and convenience require execu- Ition of the agreement described above. 3. Pursuant to the provisions of Section 50443(a) of the Government Code, that easement described in Exhibit A attached ereto be and the same is hereby vacated and abandoned. 4. The City Council of the City of Burlingame does accept that certain easement dated - 1 - UC+ i)b 87 mE "'C, executed by Anza-Pacific Corporation, a corporation. 5. The City Clerk is hereby directed to attest the signature of the City Manager to the above described Utility Agreement and record a certified copy of this resolution, a copy of the utility agreement and the deed of dedication with the County Recorder of the County of San Mateo. THROUGH PORTIONS OF LOT #7, BLOCK NO. 3 -ANZA AIRPORT PARK UNIT NO. 5; AND LOT #1, BLOCK NO. 6 -ANZA AIRPORT PARK UNIT NO. 6. A public utility easement 10 feet in width across that certain real property situate in the City of Burlingame, County of San Mateo, State of California, which easement lies 5. 00 feet on either side of the centerline more particularly described as follows: Beginning at a point which is on the West line of Lot #1, Block No. 6, said point of beginning being North a distance of 5. 014 feet from the southwesterly corner of said Lot #1, as said Lot and Block are shown on that certain Map entitled, "ANZA AIRPORT PARK- UNIT NO, 6 BURLINGAMEI SAN MATEO COUNTY, CALIFORNIA", which Map was filed in. -Volume 70 of Maps at Pages 33, 34, and 35, on February 27, 1970, Official Records of San Mateo. County, California; thence from said described point of beginning the centerline of said 10. 00 foot wide easement bears North for a distance of 270. 98 6 feet to the northwesterly corner of said described Lot #1.
