RESOLUTION 11- 75
SUSTAINING DENIAL OF VARIANCE
-- EDWARD S. GOETZ
RESOLVED by the City Council of the City of Burlingame
that:
Whereas, pursuant to the provisions of the Ordinance Code
of the City of Burlingame, a permit for a variance was applied for by
Mr. and Mrs. Edward S. Goetz, to allow an accessory building to be
erected closer than four (4) feet to a main structure; and
Whereas, after due notice and hearing said variance was
denied by the Planning Commission on December 30, 1974, as more
fully set forth in the minutes of the meeting of that date; and
Whereas, pursuant to the provisions of said Code the
decision denying the variance was appealed by the applicants to the
City Council and, upon due notice, a hearing was held thereon on
January 20, 1975;
NOW, THEREFORE, it is hereby ORDERED and DETERMINED
and FOUND that:

1. The variance application of Mr. and Mrs. Edward S.
Goetz to allow an accessory building to be erected closer than four (4)
feet to the main building on that property located at 2200 Poppy Drive,
Burlingame, was denied by the Planning Commission on December 30,
1974.
2. The denial of said variance by the Planning Commission
was appealed to the City Council as allowed by said Code and all proper

notices and procedures were duly given and followed.

3. Based on the evidence presented to the City Council
on January 20, 1975, the following findings are made:
(a) Said variance is requested from the requirements of
Section 25.28.050 of the Burlingame Municipal Code that main
structures and accessory structures must be at least four feet
apart.
(b) Said variance is for a carport constructed prior to
the application for said variance and attached to both the main
structure on the property, a residence, and the garage.
(c) No evidence was presented at the hearing of
January 20, 1975, concerning comparison of the property at
2200 Poppy Drive with surrounding properties.
4. On the basis of the evidence presented to this
Council at the hearing of January 20, 1975, it is concluded that there
are no special circumstances applicable to the property at 2200 Poppy
Drive
which,
under the
strict application of
the Zoning Ordinance,
would
deprive said
property of
privileges enjoyed
by other properties in
the
vicinity and under identical zoning classification, and that said appeal
should be denied and the Planning Commission's decision should be
affirmed.

duced at a regular meeting of the City Council held on the3rd day of
February, 1975, and adopted thereafter by the following vote:
