AFFIRMING GRANTING OF SPECIAL PERMIT

WHEREAS, on August 15, 1976, application was made to the Planning
Commission of the City of Burlingame by GEORGE DERUGIN, owner of those premises
located at 1521 Cabrillo Avenue (Assessor's Parcel No. 025-244-150); and
WHEREAS, said application requested a special permit to use a de-
tached accessory building for dwelling purposes; and
WHEREAS, said special permit was granted by the Planning Commission,
subject to conditions, following a public hearing upon said application schedules
and held on September 27, 1976, notice of said hearing having been given as
required by law; and
WHEREAS, the applicant filed a timely appeal from certain conditions
of said special permit, and a public hearing upon said appeal was scheduled and
held on the 15th day of November, 1976;
NOW, THEREFORE, it is ORDERED AND DETERMINED by the City Council of
iurlingame:

1. That the following findings of fact are made regarding said
(a) The application of GEORGE DERUGIN was for the use of an existing
uilding upon said property for library, rumpus room and occasional dwelling
urposes, said building having been built approximately 1966 without proper
uilding permits. It now consists of two rooms and plumbing fixtures, previous
itchen facilities having been removed.
(b) Said building is located across Mills Creek from the main residence
f this lot, and for the purpose of fire protection can be served only from
abrillo Avenue or through the adjacent public school site.
2. The granting of the permit applied for hereunder, without the con-
itions as set forth by the Planning Commission, would be detrimental to the heal h
nd welfare in the neighborhood, dangerous to persons dwelling in said !building,

and would not be in conformity with reasonable and orderly development.
3. The following decision of the Planning Commission is hereby
affirmed: That the special permit to use the existing accessory building at
1521 Cabrillo Avenue be approved with the conditions that it be for recreation/
library purposes only, that there be no over night occupancy'~,' and that no
kitchen facilities be installed in the building.
4. The Clerk shall cause a copy of this resolution to be recorded
with the County Recorder of the County of San Mateo.

certify that the foregoing Resolution was introduced at a regular meeting of
the City Council held on the Cth day of December, 1976, and adopted thereafter
by the following vote:
