RESOLUTION MAKING FINDINGS FOR CHAPTER 17.04
OF THE BURLINGAME MUNICIPAL CODE AMEND-
ING THE UNIFORM FIRE CODE
RESOLVED by the City Council of the City of Burlingame, as follows:
WHEREAS, the City of Burlingame has from time to time adopted the
Uniform Fire Code, most recently on September 2, 1975, and at such times has
made various amendments thereto in consideration of local conditions existing
in the City of Burlingame; and
WHEREAS, in view of recent court decisions it is necessary and
desirable that findings be established to support the local amendments to
said Uniform Fire Code; and
WHEREAS, this Council has considered the comments of the Fire
Chief and other appropriate City officials regarding said changes;
NOW, THEREFORE, it is hereby RESOLVED as follows:
1. The following sections of the Burlingame Municipal Code amend
the Uniform Fire Code, as recommended by the Western Fire Chiefs' Association
and International Conference of Building Officials, on the basis of the
findings hereinafter set forth:
Section 17.04.110. This sections concerns fire extinguishing
equipment for protection of hood and duct ventilation systems and
related cooking appliances. Presently there are no code requirements
for such installations. The installation of these systems where it
has been required has effectively controlled fires of this type. By
placing this requirement in the Fire Code it allows the fire authority
to require extinguishing systems in existing restaurant facilities
within the judgment of the fire authority or when the retroactivity
of the code would apply.

Section 17.04.120. This section concerns the installation of
automatic sprinkler systems. The basis for this amendment is that report
transmitted September 27, 1972, from the Fire Chief to the City Manager,
entitled, "City of Burlingame Fire and Life Safety Protection." As set
forth in said report, built-in fire protection such as automatic
sprinklers, holds down manpower requirements so that a city force of
the size of this city's may properly cover all areas. Further three
and four men companies justify the automatic sprinkler requirements for
offices, warehouse buildings, apartments and hotel buildings as set
forth in the ordinance. In general the automatic sprinkler requirements
enables this city, with the forces it has and the local conditions of
geography and architecture, to best meet the obligations of fire and
life safety.
Section 17.04.130. One sentence has been added to this section
since September 23, 1970, which sentence requires installation of fire
hose in a locked cabinet every other floor, starting with the third
floor of a building. The basis for this requirement is that drills
show men cannot function properly after carrying a hose pack above the
third floor of a building.
Section 17.04.210. This section concerns above -ground storage
tanks and pressure vessels. The NFPA 704M system as required by this
amendment is a nationally recognized method of identifying hazards in
flammable liquids. At the current time that is the only method that
will adequately tell the fire fighter the degree of severity of the
hazard with which he is faced. This amendment has been approved by
the Uniform Fire Committee of the Western Fire Chiefs' Association for
adoption in the 1976 Edition of the Uniform Fire Code.
Sections 17.04.250 and 17.04.270. These amendments concern
permits for welding and cutting. The requirement of additional in-
formation is an attempt to avoid deficiency points assessed against
the City by the Insurance Service Organization in rating our fire
protection facilities and codes.

2. Except as above set forth, all other sections of Chapter 17.04
of the Burlingame Municipal Code are either editorial or were adopted prior
to September 23, 1970, and in either case do not require findings.
3. The findings set forth herein are intended to reaffirm and
record the determinations made at the time the subject amendments were adopted
on September 2, 1975.
4. The City Clerk is hereby authorized and directed to file a copy
of this resolution with the Department of Housing and Community Development of
the State of California.
