RESOLUTION AUTHORIZING EXECUTION OF AGREE-
MENT FOR TENNIS COURT MAINTENANCE AND USE
WITH BURLINGAME ELEMENTARY SCHOOL DISTRICT
RESOLVED, by the CITY COUNCIL of the City of Burlingame, California,
and tAis Council does hereby FIND, ORDER AND DETERMINE as follows:
1. The public interest a-d convenience require execution of the
agreement cited in the title above.
2. The City Manager he and he is hereby authorized to sign sa,d
agreement for and on behalf of the City of Burlingame.
3. The City Clerk is hereby ordered andinstructed to attest
such signat-re.

AGREEMENT FOR TENNIS COURT
MAINTENANCE AND USE
THIS AGREEMENT, entered into this 12th day of May
,
1976, by and between tf:a CITY OF BURLINGAME, hereinafter referred to as
"City," and the BURLINGAME ELEMENTARY SCHOOL DISTRICT, hereinafter referred
to as "District,"
W I T N E S S E T H :
WHEREAS, there currently exist two tennis courts at the Burlingame
Intermediate School, a facility of the District; and
WHEREAS, it is necessary and desirable that the City and District
mutually undertake the maintenance and use of said tennis courts;
NOW, THEREFORE, it'is AGREED by the parties hereto as follows:
1. City shall let a contract for the resurfacing of the two
existing tennis courts at Burlingame Intermediate School, said resurfacing
to be accomplished by approximately July 1, 197" and shall include color
coating and lines. All costs of said resurfacing shall be the sole obligation
of City. Any subsequent resurfacing shall be performed by City only upon
mutual agreement of the parties. Immediately upon execution of this agreement,
and as a prerequisite to said resurfacing, District shall improve the drainage
from the landscaping on the west side of said courts to permanently divert
normal drainage from the courts.
2. .District shall replace the existing steel nets at said tennis
courts with fabric nets of a quality comparable to those currently in use
upon City courts. Further replacement or repair of said nets during the
term of this agreement shall be the obligation of City. District shall main-
tain said tennis courts, including such washing, sweeping or blowing as may
be necessary to keep it in a clean and safe condition.

3. Said courts shall be used solely for District purposes between
the hours of 8:00 a.m. and 3:30 p.m. on each school day, including summer
school. All other hours, including Saturdays, Sundays and holidays, .shall
be open for use by the public under the rules, regulations and procedures of
City's Recreation Department, with the School District receiving priority in
scheduling during these hours. Shorter hours of District use may be estab-
lished and posted by District as may be convenient from time to time.
4. Each party -hall carry appropriate liability insurance for its
responsibilities regarding said courts and for its periods of use, and shall
defend any actions arising out of said responsibilities or use.
5. City shall provide signs to be placed upon said courts, which
signs shall delineate the ordinary hours of use and shall specify such other
rules and regulations as are normal for public use upon said courts.
6. The term of this agreement shall be for an initial period of
two years; it shall continue from year to year for an indefinite period, but
may be terminated by either party on sixty (60) days' notice.
IN WITNESS WHEREOF, the parties have executed this agreement as of
the day first above written.
