BURLINGAME WHEREAS, on December 3, 1975, application was made to the Planning Commission of the City of Burlingame by ADOLFO LOPEZ, owner of those premises located at 1525 Cypress Avenue, Burlingame (Assessor's Parcel No. 028-301-260; Lot 25, Block 3, Burlingame Park Subdivision); and WHEREAS, said application requested a special permit for a rumpus room in an accessory building; and WHEREAS, said special permit was denied by the Planning Commission following a public hearing upon said application scheduled and held on December 22, 1975, notice of said hearing having been given as required by law; and WHEREAS, the applicant filed a timely appeal from said denial of said special permit, and a public hearing of the City Council upon said appeal was scheduled and held on the 19th day of January, 1976; NOW, THEREFORE, it is ORDERED AND DETERMINED by the City Council of Burlingame that: 1. The following findings of fact are made regarding said property: (a) The application of Adolfo Lopez was for a building to be used for rumpus room purposes and to be located on the easterly corner of said parcel, said building to be approximately sixteen by twenty-four feet in dimension. (b) The building which is the subject of this special permit application has already been commenced and substantial corrections will be necessary to meet the building codes of the City of Burlingame before said building may be used for any purpose. -1- Sci IU43 r:tic732 @ndexed (c) The location of said building will be within two feet of the side property line and within five feet of the rear property line of said property. It will be detached from the main dwelling unit on the property approximately twenty-five feet, and will be quite visible from some adjacent properties. 2. The granting of the permit applied for hereunder would be detrimental to the health and welfare in the neighborhood and would not be in conformity with reasonable and orderly development, and could lend itself to future development as an accessory living structure. 3. The decision of the Planning Commission denying the special permit as hereinabove set forth is affirmed. 4. The Clerk shall cause a copy of this resolution to be recorded with the County Recorder of the County of San Mateo. Ma or HERBERT K.
