HomeMy WebLinkAboutReso - CC - 057-1977RESOLUTION N0.57 - 77 RESOLUTION AFFIRMING DENIAL OF VARIANCE AND AFFIRMING DENIAL OF TENTATIVE SUBDIVISION MAP - LOTS 1 AND 2 OF MILLS ESTATE NO. 27 RESOLVED by the CITY COUNCIL of the City of Burlingame as follows: WHEREAS, on July 1, 1968, a subdivision known as Mills Estate No. 27 was approved by this Council, subject to the conditions that buildings in the subdivision would have only a certain height and that no additional subdivisi would be created from the subject property; and WHEREAS, it appears that while the agents and representatives of the property owners consented to and were aware of said conditions, the latter con- dition, to wit, that no additional subdivisions would be created from the property in Mills Estate No. 27, failed to be subscribed upon the parcel map which was recorded on September 26, 1968; and WHEREAS, on June 27, 1977, there came before the Planning Commission two variances and a resubdivision regarding Lots land 2 of Mills Estate No. 27, said variances being from Section 25.28.060 which requires that all lot have frontage on a public street, and Section 26.16.080 which establishes the maximum length of cul-de-sacs at two hundred fifty (250) feet; and WHEREAS, upon being informed of the condition established by this Council on July 1, 1968, the Planning Commission of the City of Burlingame denied said variances and denied the proposed tentative subdivision map of Lots 1 and 2 of Mills Estate No. 27; and WHEREAS, the denial of said variances was appealed to this Council, and the denial of said tentative subdivision map was recommended to this Counci; and WHEREAS, this Council considered the matters and the advice of 7/6/77 11 -1- the City Attorney at their meeting of July 5, 1977; NOW, THEREFORE, it is hereby ORDERED and DETERMINED that: 1. This Council reiterates and affirms the condition previously established on July 1, 1968, to wit, that there be no resubdivisions of Mills Estate No. 27 (Assessor's Parcels 025-370-010 to 025-370-090). 2. The denial of the variances set forth above, and of the resub- division map of Lots 1 and 2 of Mills Estate No. 27, are hereby upheld on the basis of said condition. 3. The City Clerk is directed to record a certified copy of this resolution. Mayor I, EVELYN H.
