RESOLUTION APPROVING PROPOSED PARTIAL
SETTLEMENT - STATE vs. SAN MATEO COUNTY, ET AL.
RESOLVED by the CITY COUNCIL of the City of Burlingame that:
WHEREAS, there was commenced in 1969 that action known as State of
California vs. San Mateo County, et al., which action concerns the title and
boundaries to certain tide and certain submerged lands in San Mateo County,
including tide and submerged lands within the City of Burlingame; and
WHEREAS, a partial settlement of said legal action has been proposed
wherein title to said lands will be determined as between the State of
California, Westbay Community Associates, and certain public agencies, but
the uses thereof remain subject to the laws and regulations of the several
public jurisdictions involved; and
WHEREAS, this Council has reviewed the "Summary of Proposed Partial
Settlement" dated June 30, 1977, and has received the recommendation of the
City Attorney that said settlement be entered into by the City of Burlingame;
NOW, THEREFORE, it is hereby ORDERED and DETERMINED that the City
Council of the City of Burlingame approves the Proposed Partial Settlement of
State of California vs. County of San Mateo, et al., San Mateo County Superior
Court Action No. 144,257, as said settlement is set forth in that document
dated June 30, 1977, and entitled "Summary of Proposed Partial Settlement."
It is FURTHER ORDERED and DETERMINED that the City Attorney is
authorized to execute such documents and take such other steps as may be
necessary to complete said settlement on behalf of the City of Burlingame.

I, EVELYN H. HILL, City Clerk of the City of Burlingame, do hereby
certify that the foregoing Resolution was introduced at a regular meeting of
the City Council held on the 5th day of July, 1977, and was adopted thereafter
by the following vote:
