HomeMy WebLinkAboutReso - CC - 042-1977RESOLUTION NO.42 - 77 RESOLUTION GRANTING SPECIAL PERMIT 1510 CYPRESS AVENUE, BURLINGAME RESOLVED by the City Council of the City of Burlingame: WHEREAS, on March 25, 1977, application was made to the Planning Commission of the City of Burlingame by NAOMI P. AllARIA, owner of those premises at 1510 Cypress Avenue, Burlingame (Assessor's Parcel Number 028-294-070); and WHEREAS, said application requested a special permit to use a detached accessory building for sleeping purposes; and WHEREAS, said special permit was denied by the Planning Commission following a public hearing upon said application scheduled and held on April 25, 1977; and WHEREAS, the applicant filed a timely appeal and a public hearing upon said appeal was scheduled and held by this City Council on the 16th day of May, 1977; NOW, THEREFORE, it is ORDERED AND DETERMINED by the City Council of the City of Burlingame: property: 1. That the following findings of fact are made regarding said (a) The application of Naomi P. Azzaria was for the use of a room attached to the existing garage upon said property for sleeping quarters for her two sons. Said room consists only of sleeping quarters and contains no plumbing or kitchen facilities. (b) The main dwelling upon said property is used for a residential care facility for the elderly as allowed by state law. The sons of the applicant are aged 13 and 19 and, due to their personal schedules, it is desirable that they sleep in the detached quarters rather than in the main dwelling unit. 5/27/77 -1- (c) Said sons of applicant have slept in the detached quarters for approximately two years, to wit, since the date of purchase and occupancy of the property by the applicant. 2. The granting of the permit applied for hereunder would be in the interest of the health and welfare of the persons dwelling in said build- ings and, subject to the conditions hereinafter set forth, would be in conformity with reasonable and orderly use of the property. 3. The decision of the Planning Commission is hereby reversed and the special permit to use the existing sleeping quarters attached to the garage at 1510 Cypress Avenue is approved subject to the condition that it be used only for sleeping by the two sons of (Naomi Azzaria, and, should the two sons vacate said quarters for a period in excess of six months, they shall be deemed to no longer inhabit said quarters and this permit shall terminate. This permit shall also terminate upon the sale or transfer of said property by Naomi Azzaria, or upon its ceasing to be used as a residential care facility for the elderly. 4. The Clerk shall cause a copy of this resolution to be recorded th the County Recorder of the County of San Mateo. Mayor I, EVELYN H.
