RESOLUTION ORDERING THE VACATION AND ABANDONMENT OF
ALLEY BETWEEN LOTS 32 AND 33, BLOCK 50, EASTON ADDI-
TION NO. 4, AND RETAINING PUBLIC UTILITY EASEMENTS
RESOLVED by the CITY COUNCIL of the CITY OF BURLINGAME:
WHEREAS, said City Council did on the 2nd day of May,
1977, adopt its Resolution No. 37-77 entitled "Resolution Declaring
Intention to Vacate and Abandon Alley and Easement Between Lots 32
and 33, Block 50, Easton Addition No. 4," declaring its intention
to vacate, abandon and close that certain alley as shown on that
certain subdivision map entitled MAC OF BLOCK 50, EASTON ADDITION
4"; and
WHEREAS, said Resolution No. 37-77 recites that said
proceedings were being taken under and pursuant to the Public
Service Easements Vacation Law of the State of California, and
expressed the election of this Council to proceed under said law;
and
WHEREAS, said Resolution No. 37-77, was duly adopted,
published and posted in the time and manner and form provided by
law, all as appears in the affidavit of publication and declarat
of posting on file in the office of the City Clerk of said City;
and
WHEREAS, Monday, the 16th day of May, 1977, at the hour
of 3:00 o'clock p.m. at the Council Chambers of the City Council
in the City Ball of the City of Burlingame was fixed in said
Resolution No. 37-77 as the time and place when and where any and
all persons interested should appear and offer evidence in con -
with the vacation of said alley; and
WHEREAS, after hearing the evidence the Council finds
that the alley hereinabove described is unnecessary for present or
rospective public use, but that an easement for storm drain and

sanitary sewer laterals should be retained and acquired by the
City;
NOW, THEREFORE, it is hereby ORDERED that said alley
as hereinabove described be and it is hereby vacated and abandoned,
provided that an easement for storm drains and sanitary sewer
laterals shall be retained and acquired by the City as set forth
in the description attached hereto as EXHIBIT A.
Upon receipt of deeds of easement for such storm drains
and sanitary sewers the City Clerk shall transmit said deeds and
a certified copy of this resolution to the County Recorder of the
County of San Mateo.

do hereby certify that the foregoing resolution was introduced at
a regular meeting of the City Council held on the16th day of
May, 1977, and was adopted thereafter by the following vote:

A. Public Utilities Easement in Lot 32 and adjoining
strip consisting of two parcels:

A portion of that 4 foot strip of land lying between
Lots 32 and 33, Block 50, as said strip is shown on that
Map entitled EASTON ADDITION TO BURLINGAME No. 4, recorded
March 4, 1907, in Volume 4 of Maps at page 57, described
as follows:
A strip of land adjacent to Lot 32 measured two feet
wide at right angle to the northwest boundary line
of Lot 32 described above and extending from the
west corner of said Lot 32 north 34' 56' east 140.00
feet to the north corner of said Lot 32.
PARCEL TWO
A portion of Lot 32, Block 50, as said lot is shown
on that map of Easton Addition to Burlingame No. 4, recorded
March 4, 1907 in Volume 4 of Maps at page 57 described as
follows: '
A strip of land lying adjacent to and southeast of, and
measured three feet wide, at right angle from the north-
west boundary line of Lot 32 described above and extend-
ing from the west corner of said Lot 32 north 34' 56'
east 140.00 feet to the north corner of said Lot 32.
B. Public Utilities Easement on Lot 33 and adjoining
strip consisting of two parcels:

A portion of that 4 foot strip of land lying between
Lots 32 and 33, Block 50, as said stip is shown on that
Map entitled EASTON ADDITION TO BURLINGAME NO. 4, recorded
March 4, 1907, in Volume 4 of Maps at page 57, described
as follows:
A strip of land adjacent to Lot 33 measured two feet
wide at right angle to the southeast boundary line
of Lot 33 described above and extending from the
South corner of said Lot 33 north 34' 56' east 140.00
feet to the east corner of said Lot 33.
PARCEL TWO
A portion of Lot 33, Block 50, as said lot is shown
on that map of Easton Addition to Burlingame No. 4, re-
corded March 4, 1907, in Volume 4 of Maps at page 57,
described as follows:
A strip of land lying adjacent to and northwest of,
and measured three feet wide, at right angle from
the southeast boundary line of Lot 33 described
above and extending from the south corner of said
Lot 33 north 34' 56' east 140.00 feet to the east
corner of said Lot 33.
