HomeMy WebLinkAboutReso - CC - 036-1977RESOLUTION NO. 36- 77 RESOLUTION APPROVING ENFORCEMENT AGENCY FOR SOLID WASTE MANAGEMENT PROGRAM WHEREAS, the County of San Mateo and its incorporated cities are required by Section 66796 of the Government Code to designate an enforcement agency to carry out the provisions of the Z'Berg-Kapiloff Solid Waste Control Act of 1976; and WHEREAS, the San Mateo County Department of Public Health and Welfare possesses the required capabilities in environmental health and solid waste management to implement the Z'Berg-Kapiloff Solid Waste Control Act of 1976 and the regulations and ordinances that have been and will be adopted pursuant thereto; and WHEREAS, the Department of Public Health and Welfare will need sufficient personnel and an adequate budget to carry out the enforcement program specified by law; and WHEREAS, the San Mateo County Solid Waste Advisory Committee recommends the designation of the Department of Public Health and Welfare; and WHEREAS, the San Mateo County Solid Waste Advisory Committee further recommends the appointment of an independent hearing panel as provided in Section 66796.58 of the Government Code; and WHEREAS, it is the understanding of this Council that the County of San Mateo and a majority of the cities within the county containing a major- ity of the population of the incorporated area of the county intend to designate the Department of Public Health and Welfare as the enforcement agency for the county and all cities contained within the county; NOW, THEREFORE, BE IT RESOLVED by the Council that it hereby approves the designation of the Department of Public Health by the County of 4/26/77 11 -1- San Mateo as enforcement agency for the county and all cities contained within the county, pursuant to subsection (a)(1) of Section 66796 of the Government Code. BE IT FURTHER RESOLVED by the Council that it hereby recommends that the County Board of Supervisors (1) provide the Department of Public Health and Welfare with sufficient personnel and an adequate budget to carry ou:tthe afore -mentioned enforcement program; and (2), appoint an independent hearing panel as provided in subsection (2) of Section 66796.58 of the Government Code. { I May*r I, EVELYN H.
